Zakat: Jewelry and Needs

Answered as per Hanafi Fiqh by Qibla.com

Answered by Shaykh Abu Usamah

I recently got married Alhumdulillah and for gifts etc my wife was given gold jewelry.. I want to calculate how much zakat I should pay… Since 1 year hasn’t passed over the jewelry that she acquired do I have to pay zakat on this jewelry? In regards to other jewelry that a year has passed can you please tell us how to calculate the amount we must pay zakat inshallah, (please give details in grams and as I have little understanding on misqal etc). Also do we pay zakat on item that are used for our daily needs, like cars etc

Answer:
In the Name of Allah, Most Gracious, Most Merciful

Al-Salam alaykum

1. Firstly, it should be understood that since the jewellery belongs to your wife it is she that has to pay the zakat. However if you pay it on her behalf as a favor to her it must be done with her consent [f: because intention is necessary in zakat].

2. Secondly, for a person that already possesses the nisab* of zakat it is not necessary that one year passes over every newly acquired wealth.

* which you should ascertain from a local ulema body there.

Hence if your wife possessed other zakatable assets that totaled to nisab it is not necessary that one year has to pass over the jewellery that she has newly acquired. Rather at the end of her normal zakat year she must add the value of her jewellery.

3. The method of calculating zakah on jewellery is to have them weighed and then determine the value of that amount of gold/silver. This value must then be added to the other zakatable assets and 2.5% of the total paid in zakah.

E.g.   If you have silver jewellery that weighs 500g and the price of silver is$10/g then the total value is $5000.

This $5000 must be added to other zakatable assets like cash (say $3000). Zakah will be paid on the total $8000 at the rate of 2.5%  =$200

(Your Question about the mithqal and the gold and silver nisab is only relevant is the jewellery is the only zakatable assets that is owned. i.e. in the absence of cash etc. For more details see the answer by Shaykh Ilyas Patel on this Hanafi List titled: Zakah on Gold & Silver) []

4. There is no zakah on items of daily necessity such as clothing, cars, or house.

And Allah Ta`ala Knows Best
