Compensation for loss when facilitating a Forex deal

Question

Person A tells me he has X amount of foreign currency and asks me (person C) to help him look for a customer to sell it to in exchange for usd. I find person B who is prepared to buy the rands at a particular rate that they agreed upon. Person A sends a fake transfer copy.

Person B gives me the usd thinking he will receive the foreign currency. I hold on to the usd without giving to person A until the foreign currency is received in the bank account.

Turns out the transfer copy was fake and no money was remitted. I return to person B his usd since the deal fell through

By the time I (person C) return the money, the rate has changed and person B claims that he made a loss of Y amount since he had committed to selling that foreign currency to someone and the rate had changed by the time he sold it.

Person B is now insisting I (person C) reimburse him for his loss since he incurred that loss because of me.

Am I liable to pay person B amount Y (the loss that he incurred)?

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The sale of currency in exchange for currency is governed by different regulations than those that apply to a sale of commodities. When one currency is sold in exchange for another currency, it is necessary that at least one of the parties takes possession of the currency from the other party. However, when possession has only taken place from one side, the market rate should be taken into consideration.

In this scenario, since no possession had taken place from either side, no transaction has taken place. Hence, there is no obligation in completing the deal.

From the information provided in the question, person C had merely facilitated the deal. Whilst the US dollars were sent to him, he is not responsible for any loss incurred. This is because no transaction has taken place.

Furthermore, ‘losses’ incurred due to fluctuation of rates over passage of time are merely a downgrading of the value of currency and are not treated as losses according to Shari’ah.

If Person B had made any commitments with other parties regarding these US dollars, then he is also not obligated to fulfil those commitments unless he has received payment from them. If he decides to fulfil those commitments, then he will be doing so at his own will. He will be responsible for bearing any loss incurred due to the fluctuation of rates or pre-agreed rates that are below or above the market rate. [i]

وأما عند أبي حنيفة وأصحابه فلأن تحريم بيع الفلس بالفلسين مبني عندهم على كون الفلوس أمثالاً متساوية قطعًا، فيبقى عند التفاضل فضل خال عن العوض، ولكن عملات البلاد المختلفة لما كانت أجناسًا مختلفة، لم تكن أمثالاً متساوية، فلا يتصور الفضل الخالي عن العوض فيجوز إذن أن يباع الريال السعودي مثلاً بعدد أكثر من الربيات الباكستانية

ثم إن أسعار هذه العملات بالنسبة إلى العملات الأخرى ، ربما تعين من قبل الحكومات، فهل يجوز بيعها بأقل أو أكثر من ذلك السعر المحدد؟ والجواب عندي أن البيع بخلاف هذا السعر الرسمي لا يعتبر ربا ؛ لما قدمنا من أنها أجناس مختلفة، ولكن تجري عليه أحكام التسعير، فمن جوز التسعير في العروض، جاز عنده هذا التعسير أيضًا، ولا ينبغي مخالفة هذا السعر

ثم إن هذه الأوراق النقدية، وإن كان لا يجوز فيها التفاضل، ولكن بيعها ليس بصرف، فلا يشترط فيه التقابض في مجلس العقد ، نعم يشترط قبض أحد البدلين عند الإمام أبي حنيفة وأصحابه؛ لأن الفلوس عندهم لا تتعين بالتعيين، فلو افترقا دون أن يقبض أحد البدلين، لزم الافتراق عن دين بدين

 

وهل يجوز هذا البيع نسيئة ؟ كما هو معمول به اليوم عند كثير من التجار وعامة الناس، أنهم يعطون عملة بلدهم، بشرط أن يؤدي الآخذ بدلها في شكل عملة بلد آخر بعد مدة، مثل أن يعطي زيد عمرا ألف ريال سعودي في المملكة السعودية ، بشرط أن يؤدي عمرو بدلها أربعة آلاف ربية باكستانية في باكستان

فأما عند الحنفية فيجوز هذا البيع؛ لأن الأثمان لا يشترط فيها كونها مملوكة للعاقد عند البيع عندهم، فيصح فيها التأجيل عند اختلاف الجنس، قال شمس الأئمة السرخسي رحمه الله : وإذا اشترى الرجل فلوسًا بدراهم ونقد الثمن، ولم تكن الفلوس عند البائع، فالبيع جائز ؛ لأن الفلوس الرائجة ثمن كالنقود. وقد بينا أن حكم العقد في الثمن وجوبها ووجودها معًا، ولا يشترط قيامها في ملك بائعها لصحة العقد، كما لا يشترط ذلك في الدراهم والدنانير
