Asking The Host About The Origin Of His Food

Answered as per Hanafi Fiqh by Darulifta Azaadville

Question:

I have come across the following narration:

Is this a general ruling, that as long as a person is a Muslim we would be required to eat his food assuming that it is Halaal due to him being a Muslim, regardless of whether it is actually Halaal and regardless to whether a person has suspicion?

Would this ruling differ from area to area, and from country to country? (I.e. In a place such as South Africa, the Muslim community is more cautious regarding Halaal and Haraam).

Would the ruling in the above mentioned Hadeeth differ from person to person e.g. if he is a pious person, if he is an Aalim in comparison to him being an open sinner. In places such as South Africa we find that to a certain extent the Fussaq are also cautious when it comes to matters related to Halaal and Haraam?

Would the ruling differ depending on what is offered to him whether it is meat items opposed to non-meat items? Or would the ruling for both be the same?

What will the ruling be if one is unaware of the condition of the person or company where he is getting his meat?
Would the ruling differ from being placed in an involuntary situation such as being given an invitation to eat, opposed to a voluntary situation where one chooses to eat at a restaurant owned by a Muslim?

What is the ruling of eating at a restaurant? Would the ruling be different for the one who eats there due to one of the following reasons?

A. He is given an invitation to eat in the restaurant.
B. He is on a journey (Musaafir).
C. Neither of the above.(i.e. He voluntary chooses to eat there whilst being at home).

Would there be a difference in the ruling if he

A. He eats his food in such a place in the restaurant in which he can be seen by one and all.
B. He eats his food in such a place in the restaurant in which he will be seen only by the middle class and high class, due to that restaurant being located in an affluent area, where one and all can easily afford the food which is being sold in that restaurant.
C. He eats in one corner of the restaurant in which no one is able to see him (i.e. he is in a vailed section of the restaurant).
D. Would the ruling be different if he orders the food and takes it away?

I have heard that the gazes of people should not fall on the food, or else the blessings will be removed and the food will be void of spirituality. Does this apply to South Africa also? Since the food is not displayed on the shelf, as opposed to India or Pakistan where much of the food is displayed on the shelf?

Those foods which are displayed on the shelf, like baking etc. In a bakery or supermarket, is generally not seen by the very poor people who cannot afford it, as opposed to India and Pakistan, where the baking is seen by thousands of poor people, with saliva dripping down their lips. Hence the effect of the gazes of the people is evident in the baking sold in India etc. Will there be any negative effect in the baking that is sold in South Africa.

Note: By South Africa, I am not referring to the very poor areas, where the food might be displayed in circumstances similar to that of India. Rather I am referring to the middle or high class areas.

Answer:

The narration cited by you is recorded in Musnad Ahmed and Tabaraani (Al Awsat) as follows:

A narration on the same topic is also found in Bukhari shareef:

  • Islam has emphasized the consumption of Halaal food and staying away from doubtful matters. A single morsel of Haraam food could cause devastating effects to one’s faith and spiritual health. The Hadeeth/s mentioned above is not general, but is in the context of pious people exercising caution in Halaal/Haraam and doubtful matters, who are well aware of the slaughtering method (according to Shariah). In fact, the Muslims at that time were from the best of people, known for their piety, knowledge and trustfulness. There is no doubt about the Tasmiyah being read at the time of slaughtering. However, it does not refer to someone known as Faasiq who transgresses the rules of Shariah and does not pay attention to the origin of his income like people we find in our time. In the first context (where the host is a pious upright person), it will not be necessary to ask him about the source of his food (based on good assumption) as understood from the apparent meaning of the Hadeeth. In the opposite scenario (where the host is a Faasiq), it will be essential to ask him or investigate before eating his food.

-Allah ﷻ says in the Qur’an:

We understand clearly from the above verse of the Qur’an that the animal on which the name of Allah ﷻ has not been pronounced (voluntarily) at the time of slaughtering cannot be consumed irrespective of who is slaughtering.-Allah’s Messenger (ﷺ) said:

In the above Hadeeth, mentioned in Bukhari, Nabi ﷺ has joined together the importance of slaughtering an animal (according to our Islamic ruling) with prayer and fasting which are pillars of Islam. It shows the fundamental importance of consuming Halaal food for a Muslim.

  • If someone stays in a country or in a locality where the majority of people are Muslim and they have true concern about Halaal matters and are known to be religious people, then we can consume their food without any problem. In the presence of doubts due to some reasons, he should stay away from it based on Taqwa (piety) and Ihtiyaat (precaution) for the betterment of his Imaan, health and honour. If the community is known to be negligent about those matters, then a person must adopt full precaution and refrain completely from their food except in the case when it is clearly proven with certainty that their food is Halaal.
  • Like mentioned previously, we will look at the piety and the outside practice of a person to determine if we can eat his food without investigation. If he is known to be an Faasiq/open sinner, we should refrain from it until we investigate and determine the source. In the case where a Faasiq gets his meat from proven Halaal sources, it will be permissible to accept his food.
  • If a taker of interest or the one who earns unlawful wealth was to give one a gift or invite one to his house for food, it will not be permitted to accept his gift or eat at his house (even non-meat items), especially when the majority of his income is unlawful, unless he informs one that it was acquired through lawful wealth which he gained through Halaal means (e.g. by inheritance or by taking a loan). And if most of his earnings are Halaal, there would be leeway in accepting his gifts or eating (non-meat items) at his house.
  • If the host is a Faasiq and one is unaware of the condition of the person or company from where he is getting his meat and the guest cannot acquire adequate information about it, then he must kindly decline the invitation, based on precaution and piety. A Muslim should stay away from things that are not only Haraam but even doubtful. In fact, Nabi ﷺ has said: “What is lawful is clear and what is unlawful is clear, but between them are certain doubtful things which many people do not recognize. He, who guards against doubtful things, keeps his religion and honour blameless. But he who falls into doubtful things, falls into what is unlawful, just as a shepherd who pastures his animals around a protected grazing ground will soon pasture his animals into it”
  • Allah ﷻ says in the Qur’an: “O Mankind, eat of that on the earth which is permissible and Tayyib” (2: 168). Tayyib refers to wholesome food for our physical and spiritual health and it is pure beyond doubt.

It will be permissible to eat at a restaurant in the three scenarios mentioned in your question with the condition that the food is proven to be Halaal (by an upright person with adequate knowledge on Halaal and Haraam and there is no real doubt in accepting his information, or by a reputable Halaal certifying body/organization) and no transgressions of Islamic rulings are taking place in that restaurant such as intermingling of males and females, playing of music, presence of alcohol etc. However, we should keep in mind that Allah ﷻ has not only ordered us to eat Halaal food but also food which is pure and healthy for our soul and body. We know that the preparation and quality of the food in restaurants are generally void of Barakah (blessings) and are not in the same level of caution and care as the food prepared at home. To eat in restaurants tarnish one’s عدالة (upright quality) and result in an act that is  خلاف مروت(indecent/inappropriate). One should avoid as much as possible to eat in restaurants and similar places when there is no valid reason to do so (a valid reason would be like in the case when a person is travelling and no other alternative is found).

  • If a person is eating in an open place where envious people can glance at the food, it will be better for him to leave the place or eat in a place where such persons cannot see the food. The effect of evil eye is real and cannot be denied but one must keep in mind that everything is from Allah ﷻ and only He decides the end result of something. If only Allah ﷻ wills, the evil eye will have an effect but by itself does not have any power. The Sunnah method of eating (with all its etiquettes) must be practised upon, then with Allah’s Help and Decision, Insha-Allah nothing will happen to him.
