Talaaq Uttered By Mistake

Question:

I was having an argument with my husband in our car and I then asked for my Talaq. My husband uttered TALAQ twice in front of our children and got off the car.

Later my mother in law called and said it was a mistake.

Then they said he was not in his senses.

After the incident we separated for 2 years. Now he is refusing and saying that he didn’t give Talaq.

Am I still in his Nikah ?

Answer:

The two Talaaqs issued in the mentioned situation are binding . Consequently, the Nikah between yourself and the man concerned has been terminated if he did not take you back in his Nikah during your ‘iddah. If you wish to remarry, you may perform a new Nikah with a new mehr.

الطلاق على ضربين صريح وكناية فالصريح قوله أنت طالق ومطلقة وطلقتك فهذا يقع به الطلاق الرجعي ” لأن هذه الألفاظ تستعمل في الطلاق ولا تستعمل في غيره فكان صريحا وأنه يعقب الرجعة بالنص ” ولا يفتقر إلى النية ” لأنه صريح فيه لغلبة الاستعمال ” وكذا إذا نوى الإبانة ” لأنه قصد تنجيز ما علقه الشرع بانقضاء العدة فيرد عليه
