Answered as per Hanafi Fiqh by Mahmoodiyah

Question:

Assalamualaikum wa rahmatullahi wa barakatuhu

Respected mufti sahib

1. Could u please explain how the Madhab Shafi’ee and Hanafi differ on the reading of the Qunoot in Fajr Salaat ?
What based or Hadith does Shafi’ee Madhab refer to ?
2. What does it mean by Istimbaat ?

Jazakallah

Wassalamu alaikum. Wa rahmatullahi wa barakatuhu.

Answer:

According to the Shafi’ees, reciting the Qunoot in the Fajr Salaah is necessary. The Hanafis recite it in the times of calamity. In the Qunoot of Fajr, the Shafi’ees raise their hands in a Du’aa form, whereas the Hanafis keep their hands at their sides. Reference to the Hadith that the Shafi’ees take can be found in Sunan Abu Dawood, Page 201, Kitaabul Majmoo’ of Imam An-Nawawi Vol. 3, Page 473-474.

Istimbaat means to deduce of a ruling after contemplating on a clear ruling of either Qur’an or Hadith.
