Question on Calamari

Answered as per Hanafi Fiqh by Mahmoodiyah

Question:

Assalamualaikum

Mufti sahib, can a Hanafi eat calamari? is it Makrooh Tahrimi (close to Haraam) or Haraam?

I always think of the fact that how can one thing be Haraam for one Muslim and not for the other? For example in order for Du’aas and Salaah to be accepted Food must be Halaal. Now what happens if a Hanafi stands behind a Shafi’ee and he ate Calamari and Prawns, is the Salaah behind that imam correct?

What about this.

If i am a Hanafi and if i touch a women or blood flows then my Wudhu doesn’t break, now what if a Shafi’ee follows me and he knows that this happened to me, and according to Imam Shafi’ee (R.A.) the above 2 cases break the Wudhu, what then does he make and intention to follow me and  is his Salaah correct?

Shukran

The Oxford English Dictionary defines calamari as “a squid served as food.” The Arabic dictionary Al-Mawrid also gives the same meaning. Squid is not regarded as a fish; therefore it would be unlawful for one following the Hanafi School to consume calamari.

According to the Math-hab of Imam Shafi’ee, apart from fish there are many other sea creatures which are also Halaal. As a result if a Shafi’ee eats calamari and thereafter leads the congregation in Salaah, the Hanafis Salaah will not be affected in anyway, since calamari according to the Shafi’ee Imam is Halaal.

According to the Hanafi Math-hab, the Wudhu does not break by merely touching a woman. However, if one bleeds the Wudhu will be nullified. It will not be permissible for a Hanafi to perform Salaah in this condition.

We have not come across the ruling of Imam Shafi’ee with regards to the Salaah of a Shafi’ee Musalli who performs his Salaah behind a Hanafi Imam who touched a lady prior to Salaah.
