Advertising a Valentine’s sale

Question

Assalamualaikum w.w Mufti, 

Is it allowed for businesses to advertise products /promotions for valentine’s only for business purposes. Please advise. Jazakallah khair. 

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

As muslims, we are sensitive to our Imaan and Tawheed (Oneness of Allah) We live by our Islamic values and disassociate ourselves from anything against Tawheed and Islamic Values. Valentines has its roots in kufr and un -Islamic practices.

Valentine’s Day began as a pagan ritual started by Romans in the 4th century BCE to honour the god Lupercus. The main attraction of this ritual was a lottery held to distribute young women to young men for “entertainment and pleasure”–until the next year’s lottery. Among other equally despicable practices associated with this day was the lashing of young women by two young men, clad only in a bit of goatskin and wielding goatskin thongs, who had been smeared with blood of sacrificial goats and dogs. A lash of the “sacred” thongs by these “holy men” was believed to make them better able to bear children.[1]

Hence, it is not permissible for a Muslim to advertise a Valentine’s sale or anything related to Valentine’s as that will be promoting or assisting in a sinful/un-Islamic practice.

 

Purchasing Items from a Valentine’s Sale

Items sold in relation to Valentine’s Day may be classified into three categories:

  • Those that do not have any relation to Valentine. However, the store marks the prices down due to the valentines season. The purchase and sale of such items will be permissible.[2]
  • Those items which are exclusive to Valentine’s Day, for example, Valentine’s Day cards. The purchase and sale of such items will be impermissible.[3]
  • Those items which are generally permissible to buy and sell, such as chocolates and flowers, but they have symbols of Valentine. It is Makrooh (resented) to purchase and sell such items.[4]

والإعطاء باسم النيروز والمهرجان لا يجوز) أي الهدايا باسم هذين اليومين حرام بل كفر وقال أبو حفص الكبير – رحمه الله – لو أن رجلا عبد الله تعالى خمسين سنة ثم جاء يوم النيروز وأهدى إلى بعض المشركين بيضة يريد تعظيم ذلك اليوم فقد كفر وحبط عمله وقال صاحب الجامع الأصغر إذا أهدى يوم النيروز إلى مسلم آخر ولم يرد به تعظيم اليوم ولكن على ما اعتاده بعض الناس لا يكفر ولكن ينبغي له أن لا يفعل ذلك في ذلك اليوم خاصة ويفعله قبله أو بعده لكي لا يكون تشبيها بأولئك القوم، وقد قال – صلى الله عليه وسلم – «من تشبه بقوم فهو منهم» وقال في الجامع الأصغر رجل اشترى يوم النيروز شيئا يشتريه الكفرة منه وهو لم يكن يشتريه قبل ذلك إن أراد به تعظيم ذلك اليوم كما تعظمه المشركون كفر، وإن أراد الأكل والشرب والتنعم لا يكفر

بخروجه إلى نيروز المجوس والموافقة معهم فيما يفعلون في ذلك اليوم وبشرائه يوم النيروز شيئا لم يكن يشتريه قبل ذلك تعظيما للنيروز لا للأكل والشرب وبإهدائه ذلك اليوم للمشركين ولو بيضة تعظيما لذلك اليوم

والقسم الثالث: ما وضع لاغراض عامة ويمكن استعماله فى حالتها الموجودة فى مباح او غيره…

والظاهر من مذهب الحنفية انهم يجيزون بيع هذا القسم وان كان معظم منافعه محرما…

ولكن جواز البيع فى هذه الاشياء بمعنى صحة العقد اما الاثم فيتأتى فيه ما كرناه فى شروط العاقد من انه اذا كان يقصد به معصية بائعا او مشتريا فالبيع يكره تحريما وذلك اما بنية فى القلب او بالتصريح فى العقد ان البيع يقصد به محذور. اما اذا العقد من الامرين ولا يعلم البائع انه يستعمله فى مجذور فلا اثم فى بيعه. وان علم البائع انه يستعمله فى محذور وكان سببا قريبا داعيا الى المعصية فيكره له البيع تحريما. وان كان سببا بعيدا لا يكره
