Question:
Kawwa is Haraam in our Shari at but the biggest Mufti of Darul Uloom Deoband Molvi Rashid Gangohi in his book “Fataawaa Rashidiyyah” has written that Kawwa eating is Thawaaab…
Please clarify that is it Haraam or Thawaaab.
Answer:
That crow which eats seeds and grains is Halaal unanimously according to Fataawaa Aalamgeeri and Fataawaa Shaami. Allamah Shaami wrote regarding this that it is a small black crow called Zaagh, and sometimes the colour of its beak and feet is red .He has written also that the crow eats seeds then it is Halaal , whether it is Zaagh ,spotted crow, or black crow .[Ad Durrul Mukhtaar, Vol.5, Page 216; Fataawaa Aalamgeeriyyah, Vol.5, Page 289].From who did you hear saying that crow is Haram? If you have proof, then please bring it forward.
In Fataawaa Shaami, it is Afdhal [more virtuous] to perform Wudhu’ from a pond. The Mu’tazilites, however contradict to this because they regard it impermissible. [Ad Durrul Mukhtaar vol. 1, Page 137]. In like manner are the Rawaafidhs [the Shiites]; they regard Mash [wipe] on leather socks impermissible. That is why, in any occasion, if there is a fear that a person would be accused of being a Raafidhi because of not making mash on leather socks, then it is Afdhal for him to perform it in order to avoid this accusation. [Ad-Durrul Mukhtaar Vol. 1, Pageg.193] .
Hadhrat Jaabir [R.A.] once owned a full set of clothing but he read his Salaah while only having a sheet wrapped around him as this was enough to cover his Aurah.
This was done to show that Salaah is permissible with such this clothing, because some people understood that Salaah is not correct with one sheet only. [Sahih Bukhari, Vol.1, Page.53].
Once, Hadhrat Ali [R.A.] performs Wudhu’ in front of the people in Kufa, and then, he drank the remaining water of Wudhu while standing. Then he addressed the public, saying, some people regard drinking while standing is Makrooh, whereas Nabi [S.A.W] also used to drink the remains of Wudhu while standing like me.” [Sahih Bukhari, Vol.2, Page.84.]
It is determined that occasionally, without any constrain, any permissible action has to be performed, so that the public could know the Mas’ala and saved from incorrect understanding. By doing this, the person who informs the Mas’ala will get Thawaab [reward]. Mufti Rashid Ahmed Gangohi Rahmatullahi Alayhi once was asked in the similar way, “That place where most of the people regard crow as Haram , and regard its eater as evil , in such a place , does the eater will be rewarded or not nor will he be punished ?( the answer to this was )he will be rewarded.”
With regards to the similar question, the answer has been given. The principle is that, in answers, questions are also mentioned, although it is not written. If you study the answer together with the question, your suspicion would have certainly been removed. The great Mufti of Deobandis wrote this matter only that which is confirmed according to the Shari’ah .Only, Allah Ta’ala is more knowing of whatever is correct.
