Is a wife responsible for her deceased husband’s debts?

Answered as per Hanafi Fiqh by Qibla.com

Answered by Shaykh Faraz Rabbani

If a woman’s husband has passed away, and he has loans on him, does the wife needs to repay his loans and if she can not repay the loan then what is the other way.

Answer:
In the Name of Allah, Most Gracious, Most Merciful

Walaikum assalam wa rahmatullah,

I pray this finds you in the best of health and spirits.

[1] The basis is that each person is responsible for their own debts, and no one else is obligated to pay these debts on their behalf.

[2] However, a person’s debts to other people are to be paid off from their estate after death before any inheritance is divided, even if this uses up their entire wealth. In cases of this not happening, one should consult a scholar about the specifics of the situation.

[3] It is from the general praiseworthy actions to assist others in life and in death, and one of these ways is to clear their dues by paying there debts. However, this is a purely voluntary matter. One shouldn’t feel an obligation to do this; nor should one be pressured into doing so contrary to one’s choice.

And Allah alone gives success.

Faraz Rabbani
