Kaffara or Qadha: What’s Required for a Broken Fast?

Q: I read on Islamiqa that a kaffara is only due on a broken fast, if the fast was broken due to sexual intercourse, there is no need for kaffara. If the fast was broken due to delebretly eating or drinking, only qadha is necessary. Is this right?

A: Kaffarah and qadha are for both, eating as well as intercourse.

And Allah Ta’ala (الله تعالى) knows best.

ولو أكل أو شرب ما يتغذى به أو ما يداوى به فعليه القضاء والكفارة وقال الشافعي رحمه الله لا كفارة عليه لأنها شرعت في الوقاع بخلاف القياس لارتفاع الذنب بالتوبة فلا يقاس عليه غيره ولنا أن الكفارة تعلقت بجناية الإفطار في رمضان على وجه الكمال وقد تحققت وبإيجاب الإيمان تكفيرا عرف أن التوبة غير مكفرة لهذه الجناية (هداية 1/219)
