Hanafi and Shafi Fiqh

Dear Brothers, my question is very simple but complicated. I am the firm follower of hanafi fiqh but whenever my friend from Shafi maslak asks me some questions or rather gives me proof from quran and sahih hadith, i am not able to show him any proof. Because most of the hanafi fiqh scholars never give me proper proof. They just say believe in what we say as we also beleive in our elders. Many massail like rafa ul yadain, aameen bil jahar,etc are my concerns. Can you give me some refrences about these masaail and let me know where i can get all the sahih hadith in our to prove my point to a person.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. 

Taqleed means to follow the Imam of your mazhab without asking for any proof. You should simply tell the person you have been trained to follow your mazhab and respect other mazhabs. Engaging in proofs with uneducated people is incorrect. Be rest assumed all the Imams of the four schools of thought were great scholars and each one has substantiated his opinion from reliable sources of Shariah. Nevertheless, hereunder are some basis for the two issues you enquired about.

According to the Hanafi school of thought, one should not raise his/her voice when sayig “Ameen”.

The hadith is mentioned below:

سنن الترمذي ت بشار (1/ 332)

أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَرَأَ: {غَيْرِ الْمَغْضُوبِ عَلَيْهِمْ وَلاَ الضَّالِّينَ}، فَقَالَ: آمِينَ وَخَفَضَ بِهَا صَوْتَهُ

Translation: when Nabi Sallahu Alayhi Wa Sallam read (the last verse of surah fatiha), he said Ameen in a soft voice. (Sunan Tirmizi V.1 Pg.310 #248)

Also, a Hanafi follower should not raise his/her hands before going to Ruku’ and after Ruku’.

The Hadith is mentioned below:

سنن الترمذي ت بشار (1/ 317)

 أَلاَ أُصَلِّي بِكُمْ صَلاَةَ رَسُولِ اللهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ؟ فَصَلَّى، فَلَمْ يَرْفَعْ يَدَيْهِ إِلاَّ فِي أَوَّلِ مَرَّةٍ

Translation: Ibn Masood said “have I not demonstrated for you the prayer of Nabi Sallahu Alayhi Wa Sallam? When Nabi Sallahu Alayhi Wa Sallam would pray, he would not raise his hands except in the beginning (takbeer tahreema). (Sunan Tirmizi V.1 Pg.317 #256)

In any way, people who are dogmatic in their approach may not find these substantiations sufficient and will search for flaws in them too. At that stage you may realize the wisdom of not entering in to academic arguments in issues of taqleed.
