Assalaamu `alaykum waRahmatullahi Wabarakatuh

1. The time for Witr salah is the same as the time of Esha salah, but it is compulsory to maintain the sequence between Esha salah and Witr salah. Hence, if one intentionally performs Witr salah before Esha salah, the Witr salah will not be valid and it will be compulsory upon him to repeat it after performing Esha salah. However, if Witr salah was involuntarily performed before Esha salah, it will not be necessary to repeat the Witr salah. For example, if one performs Witr salah on the premise that he had already performed Esha salah, it will not be necessary for him to repeat his Witr salah when he remembers later that he had not performed Esha salah. Similarly, if one performs his Esha salah without wudu and thereafter performs Witr salah in the state of wudu, it will not be necessary for him to repeat his Witr salah after he realises later that he had performed Esha salah without wudu.

( قوله : والعشاء والوتر منه إلى الصبح ) أي وقتهما من غروب الشفق على الخلاف فيه وكون وقتهما واحدا مذهب الإمام.

( قوله : ولا يقدم على العشاء للترتيب ) أي لا يقدم الوتر على العشاء لوجوب الترتيب بين العشاء والوتر ولأنهما فرضان عند الإمام وإن كان أحدهما اعتقادا والآخر عملا فأفاد أنه عند التذكر حتى لو قدم الوتر ناسيا فإنه يجوز.

( و ) وقت ( العشاء والوتر منه إلى الصبح ، و ) لكن ( لا ) يصح أن ( يقدم عليها الوتر ) إلا ناسيا ( لوجوب الترتيب ) لأنهما فرضان عند الإمام .

الشرح

( قوله : ولكن إلخ ) جواب عن سؤال مقدر تقديره لم لا يجوز تقديمه بعد دخول وقته .

أجاب بأنه إنما لا يجوز للترتيب لا لكون الوقت لم يدخل ، وهذا على قوله وعلى قولهما ؛ لأنه تبع للعشاء ، وأثر الخلاف يظهر فيما لو قدم الوتر عليها ناسيا أو تذكر أنه صلاها فقط على غير وضوء لا يعيده عنده ، وعندهما يعيد نهر ، ولم يتعرض للمسقط الثالث وهو كون الفوائت ستا فليراجع رحمتي .

( قوله : لوجوب الترتيب ) أي لزومه فإنه فرض عملي ط .

( قوله : لأنهما فرضان عند الإمام ) لكن العشاء قطعي والوتر عملي ، وهذا تعليل للحكمين المذكورين في المتن : الأول كون ما بين غيبوبة الشفق والفجر وقتا لهما معا .

الثاني لو صلاه قبلها ، فإن ناسيا سقط الترتيب ، وإن عامدا فهو باطل موقوف على ما سيأتي تفصيله في قضاء الفوائت ح .

2. Allah Ta’ala refers to the flesh of a pig as an impurity, in the Holy Quran:

…أو لحم خنزير فإنه رجس…

… or flesh of swine – because it is impure – … (Verse: 6:145)

The impurity is in the skin itself and not due to any outside factor, as is the case in the skins of other animals. Hence, the impurity in pig-skin cannot be removed by tanning, chemically modifying into leather or any other process.

When one touches pig-skin leather with a wet hand, the impurity is transferred onto the hand; thus, the hand also becomes impure.
