Remarriage After Khula’ (Wife Initiated Divorce)

Question:

I am trying to reconcile the marriage with my ex-wife.

A Dār Al-Qaḍā (Islamic Tribunal) granted her the khulaʾ certificate last year. My father approached her mother and proposed remarriage. As per their understanding it is not permissible in Islam for us to reconcile and remarry. Can you please provide a formal islamic legal ruling or document stating the islamic law regarding our circumstance.

A faskh/ khula of nikāḥ (religious divorce initiated by the wife) has the same effect as a ṭalāq bā’in (irrevocable divorce), meaning your previous nikāḥ has terminated with your ex-wife when the Dār Al-Qaḍā (Islamic Tribunal) issued the khula certificate.  Therefore, in your case, according to islamic law, you can only get back together as a husband and wife with a new proposal and new formal nikāḥ contract.  – (See: Al-Fiqh ʾAlā Madhāhib Al-Arbaʾah, Rad-Al-Muḥtār, Page 91, Kitāb Al-Khulʿa, Volume 5, Dār Al-Ālam Al-Kutub [1])

The great jurist, Muftī Khālid Saifullāh Al-Raḥmānī writes, “After khula, all jurists are of the view that without a new nikāḥ, there is no islamic right of reconcilation.” – (See: Qāmūs Al-Fiqh)

(وَ) حُكْمُهُ أَنَّ (الْوَاقِعَ بِهِ) وَلَوْ بِلَا مَالٍ (وَبِالطَّلَاقِ) الصَّرِيحِ (عَلَى مَالٍ طَلَاقٌ بَائِنٌ)

(قَوْلُهُ: وَالْخُلْعُ مِنْ الْكِنَايَاتِ) لِأَنَّهُ يَحْتَمِلُ الِانْخِلَاعَ عَنْ اللِّبَاسِ، أَوْ الْخَيْرَاتِ، أَوْ عَنْ النِّكَاحِ عِنَايَةٌ، وَمِثْلُهُ الْمُبَارَأَةُ (قَوْلُهُ: فَيُعْتَبَرُ فِيهِ مَا يُعْتَبَرُ فِيهَا) وَيَقَعُ بِهِ تَطْلِيقَةٌ بَائِنَةٌ إلَّا إنْ نَوَى ثَلَاثًا فَتَكُونُ ثَلَاثًا، وَإِنْ نَوَى ثِنْتَيْنِ كَانَتْ وَاحِدَةً بَائِنَةً كَمَا فِي الْحَاكِمِ (قَوْلُهُ: مِنْ قَرَائِنِ الطَّلَاقِ) كَمُذَاكَرَةِ الطَّلَاقِ وَسُؤَالِهَا لَهُ. وَفِي الدُّرِّ الْمُنْتَقَى: وَتَسْمِيَةُ الْمَالِ وَإِنْ لَمْ يَكُنْ مُتَقَوِّمًا مِنْ الْقَرَائِنِ. اهـ. ط (قَوْلُهُ: لَوْ قُضِيَ بِكَوْنِهِ فَسْخًا) أَيْ كَمَا هُوَ قَوْلُ الْحَنَابِلَةِ إنَّهُ لَا يَقَعُ بِهِ طَلَاقٌ بَلْ هُوَ فَسْخٌ – رد المحتار كتاب الخلع
