Question

My brother is intending on taking our Mother to Hajj this year Insha Allah. However, our aunty, who is my mother’s cousin sister wishes to join them. My question is, Is our aunty allowed, as we don’t know if she is a Mahram?

Answer

Your mother’s cousin’s sister is not a Mahram, hence, she will not be allowed to go to Hajj with you as a Mahram.

One of the conditions for Hajj to be fardh (compulsory) is that a woman should travel with her husband or mahram. A mahram is a person whom marriage is not allowed i.e. father, son, son’s son etc… (Fatawa Hindiyyah p.218 v.1)

It is unlawful for a woman to travel for a distance of 48 miles (88km) or more without her husband or her Mahram. This rule applies whether the journey is for hajj or worldly purposes.

Sayyidina Ibn Abbas (RA) narrates from the Prophet of Allah (SAW) “Never should a woman journey but with a Mahram.” (Sahih Bukhari P.250 v.1)
