Failure to Trace Owner

Answered as per Hanafi Fiqh by CouncilofUlama.co.za

Q: I owe two people some money but cannot trace these people. I have tried my best to locate them but failed. What should I do as I have the money to pay them? Can I donate the money on their behalf to a masjid or madressa project and intend it accordingly on their behalf? What should I do if they are found later in the future?

A: After a reasonable time and effort, try to first find his family or heirs and leave it with them. Obtain a receipt as proof. If not, donate to a charity on his behalf and obtain receipt. If he surfaces, explain to him what you did and show him the proof. If he doesn’t accept, you have to refund his money.

And Allah Knows Best
