Permissibility of Abortion at 3/4 Weeks

Hey!

I am 18 years old guy who is in high school and I have fall in love with the girl who is 18 also…we are younger in our family so our family were not even ready to think about out marriage so we decided to do nikah without telling them with my 2 counsins as a witness and one qazi. so the nikah was valid everything was good and we still live separate without telling out parents anything about it and we meet with each other every week. Now my wife good pregnant by accident. its been only 20 25 days yet. If our parents know this they will kick us out from home and how we gonna handle this situation. Is abortion halal because its been only 3 to 4 weeks. Can you please help us in this situation we are still students.

Abortion is not permissible without extreme compulsion. In your case, since it is a post-nikah pregnancy, with no constraint except for the fear of embarrassment in the family, abortion is therefore not allowed in your case.

There is no excuse for being married according to shari’ah, therefore do not worry about the family’s reaction in this regard. It is better to inform the family members about the marriage, because declaration of marriage is encouraged in the Ahadith.

While there are many benefits associated with it, there is however danger of many misfortunes in hiding this news:

For example, suspicions of people, abortion in the present case, worries of the girl's parents about her marriage, and united approach of the community in spreading false rumors and confusion, will certainly create  new and bigger problems for you.

’’عَنْ عَائِشَةَ قَالَتْ: قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم:  أَعْلِنُوا هَذَا النِّكَاحَ، وَاجْعَلُوهُ فِي الْمَسَاجِدِ …‘‘ الحديث. (سنن الترمذي، باب ما جاء في إعلان النكاح

ویکرہ أن تسقی لإسقاط حملہا، وجاز بعذر حیث لا یتصور۔ (الدر المختار) وفي الشامي: ویکرہ أي مطلقًا قبل التصور وبعدہ علی ما اختارہ الخانیۃ۔ (الدر المختار مع الشامي ۹؍۶۱۵ زکریا، فتاویٰ قاضي خان علی الہندیۃ ۳؍۴۱۰)

وفي الیتمۃ: سألت علي بن أحمد عن إسقاط الولد قبل أن یصور، فقال: أما في الحرۃ فلا یجوز قولاً واحدًا۔ (الفتاویٰ الہندیۃ ۵؍۳۵۶)

وإذا أمسک الرحم المني فلا یجوز للزوجین ولا لأحدہما ولا للسید التسیب في إسقاطہ۔ (فتح العلي مالکي ۱۱؍۳۹۹ بحوالہ: کتاب الفتاویٰ ۶؍۲۲۱)
