How can one family properly distribute the wealth of a deceased person who has no sons?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
My mother-in-law passed away her husband is alive and has three daughters no son. Her brother and sisters have passed away too. How do we distribute her wealth please advise us to distribute her remaining. Her brother’s son and two daughters are alive are they entitled to get anything too? Please, make dua for her maghfirah.

Answer

(Fatwa: 1290/1046/B=1433)

In the question mentioned above, the inheritance of your mother-in-law shall be divided into 36 shares, out of which her husband shall get one forth i.e. 9 shares, and all the three daughters shall get two third i.e. 24 shares while remaining 3 shares shall go to the bhatija being as asaba (kinsman) and bhatiji shall get nothing. The detail of Shariah division is as follows:

Details:
Husband: 1×09 = 09
Daughters: 3×08 = 24
Bhatija: 1×03 = 03
Total: 36 shares
