A deceased women left 1 husband 1 daughter 1 mother 1 father 2 brothers and 1 sister.

I would like to know how the wealth be distributed amongst the heirs. We can take an example that women left 1000 RS in total wealth. Or you can explain with ratio of wealth to be distributed amongst heirs.

According to the Shari’ah Laws of Inheritance and Succession, distribution of an estate will only commence after funeral expenses, debts (including legal costs) and bequests (if any) made to non-heirs – which will not exceed one-third (1/3) of the estate after debts and funeral expenses have been settled. Thereafter, all assets form part of the net estate and will have to be distributed according to the Islamic Law of Succession and Inheritance.

We have been advised that the deceased is survived by,

  • Husband
  • One daughter
  • Mother
  • Father
  • Two brothers
  • One sister

Accordingly, the estate of the deceased will be divided into 13 shares as follows:
