Can I give away a gift?

Answered as per Hanafi Fiqh by Qibla.com

Answered by Shaykh Faraz Rabbani

I given a personal item as a gift by an aunt (I have been told by others it is expensive). I accepted it initially as I believed it was an act of kindness and did not wish to offend them. However, I have found I have no use for the gift. A fellow brother has expressed a interest in it, and would like to have it. Assuming that the giver of the gift is not present, is it permissible to give this gift away to the brother ? I seek no favours from him, and the giver of the gift will not be present and inshAllah not likely to find out.

Answer:
In the Name of Allah, Most Gracious, Most Merciful

In the Name of Allah, Most Merciful and Compassionate

Walaikum assalam wa rahmatullah,

Once you take possession of a gift, you own it. As such, you can dispose of it as you wish. However, some social sensitivity, tact, and wisdom should be used, so that one doesn’t hurt the feelings of the one who gave the gift.

And Allah alone gives success.

Wassalam,

Faraz Rabbani
