We made a “کلما” divorce agreement with the academy. Is it ok?

Answered as per Hanafi Fiqh by Jamia Binoria

I teach in an online academy. We made a “کلما” divorce agreement with the academy. It is written in the agreement that, “If you take any student’s phone number or give your phone number to any student, then “کلما” divorce will occur.” So in this case, if any student says to me, “Please take down my number, I have to speak to you at a later time,” and I write down their number and even speak with them at a later time, will divorce occur or not? We only wrote our signature on the agreement. There was no verbal approval.

The words that was written on the agreement of the academy, that, “If you take any student’s phone number or give your phone number to any student……” as per Shari’ah, no “تعلیق” (Conditional Divorce) was caused by these words. For this reason, if any teacher were to breach the agreement by giving their number to a student or taking their (i.e. a student’s) number, then even though as a result divorce will not occur upon his wife, because doing such is opposing the agreement, one will be sinful for giving his number to the student or taking the student’s number. Hence, doing such is not permissible for the questioner also and it must be avoided.
And Allah knows best.
