Quoting statements of disbelief

Question

Is it permissible to quote a statement of kufr, without explicitly saying “he said, they said” or the like before the statement. For example one intends on quoting a statement but doesn’t provide a quoting statement, would this individual blaspheme.

Would one have to say ‘so called’, before for example saying “Saint Thomas Aquinas”, since we know he is a kafir and a kafir can’t be a saint. Or is it understood through our beliefs and just recommended not to call him a saint?


Answer

Our jurists have ruled that the utterance of a statement of kufr, even if one does not believe in the utterance, is reprehensible and takes one out of the fold of Islam.[1] To explicate this ruling, let us consider the statement of kufr, “Jesus is the son of God”.

If an individual says, “Christians say that Jesus is the son of God” or says this statement with air quotes in a context where Christian’s are being cited, this would not be kufr. One is merely representing the views of others, and this should be made clear.

If an individual makes this statement as a matter of fact, with no contextual or textual clues to indicate one’s intention of representing another view, this is a kufri statement. As a legal axiom in the Hanafi school, the jurists have accepted weak opinions and interpretations to not discharge someone with disbelief. However, as personal practice, the jurists have advised that such an individual repent, renew their shahada and their marriage[2] as a matter of precaution.[3]

As for attaching “Saint” before Aquinas’ name, this is not a statement of kufr outright – though, should be avoided due to the considerations implied in the question i.e., we do not consider him to be a Godly person, but a disbeliever. Moreover, Aquinas is rarely spoken of as “Saint Thomas Aquinas”, so others will not consider it peculiar should “Saint” be omitted. In fact, including “Saint” might raise eyebrows in secular contexts as Aquinas is not known through this epithet, but merely Thomas Aquinas.

[2] Renewing one’s marriage is a simple affair that can be achieved in a a few minites. One merely presents the offer and acceptance, stipulating a small dowry, in front of two Shar’i witnesses (two males or one male and two females). One does not need to do this publically or feed people. The scholars of the past would recommend that an individual should renew their marriage at regular intervals, due the prevalence of kufri statements in the people’s vernacular.
