Destroying Haram Items Owned by Another Person

Assalamu ‘alaykum warahmatullahi wabarakatuhu Mufti Sahib,

Is it permissible to take or destroy someone else’s (haram) properties in order to avoid him/her using them (and thus him sinning)?
Such as hiding/throwing away tight jeans, music cds, etc..

Does it make any difference in the ruling is the person performing such an action is someone “responsible” over the person whose goods are taken/destroyed, such a father/husband destroying something haram owned by his children/wife; or can anyone take and destroy anything haram owned by any other Muslim (as a woman throwing something owned by her own sister, etc.).

Answer

Wa’alaykum as Salam wa rahmatullahi wa barakatuhu,

A person can only destroy the belongings of others on two conditions:

1) He has to be absolutely certain that by breaking the item, the person will abandon his evil,

2) If the item in question has no other use besides something impermissible (e.g. a guitar can only be used for music). Hence if the item does have multiple usages (e.g. cell phone, radio, etc can be used in permissible ways), it will not permissible to destroy it.

If these conditions are met then Islamically, a person will not be responsible for destroying such items. Yes, payment should be done for the raw material which was used to make up that item.
However, a person should use wisdom when doing Nahy ‘anil munkar (prohibiting from evil). First, he should advise and try to convince a person to leave his wrong on his own will.

If breaking the item will cause a person to go further from Islam, then he should rather avoid destroying the property of others.

As for a guardian, or someone who has authority, for them, it will be preferable and highly recommended to destroy the impermissible items.

(قال) ولا قطع في الدف وما أشبهه من الملاهي، أما عندهما فلأنه ليس بمال متقوم حتى لا يضمن متلفه، وعند أبي حنيفة – رحمه الله تعالى -، وإن كان يجب الضمان على المتلف باعتبار معنى آخر فيه سوى اللهو والمقصود التلهي به، ولا يمكن اعتبار القطع باعتبار المقصود، ولأن للآخذ تأويلا في أخذه؛ لأنه يقصد به النهي عن المنكر، وهو استعماله للتلهي فيصير ذلك شبهة (المبسوط للسرخسي – 9 / 154)

ويكره خرق الزق الذي فيه خمر لمسلم عند أبي حنيفة – رحمه الله – ولو خرق يضمن وعند أبي يوسف ومحمد لا يكره ولا يضمن وعلى هذا الخلاف كسر آلات الملاهي من البربط والعود والزمارة ونحوها (بدائع الصنائع في ترتيب الشرائع – 5 / 129)

إذا كسر بربط إنسان أو طنبوره أو دفه أو ما أشبه ذلك من آلات الملاهي فعلى قولهما لا ضمان وعلى قول أبي حنيفة رحمه الله تعالى يجب الضمان وذكر في الجامع الصغير أن على قول أبي حنيفة رحمه الله تعالى يضمن إلا إذا فعل بإذن الإمام قال القاضي الإمام صدر الإسلام الفتوى على قولهما لكثرة الفساد فيما بين الناس وذكر الشيخ الإمام فخر الإسلام في شرح الجامع الصغير أن قول أبي حنيفة رحمه الله تعالى قياس وقولهما استحسان وقال صدر الإسلام ثم عند أبي حنيفة رحمه الله تعالى إذا وجب الضمان يجب على وجه الصلاح لغير التلهي على أدنى وجه يمكن الانتفاع بذلك وعلى هذا الخلاف النرد والشطرنج لأنه يمكن أن يجعل هذه الأشياء سنجات الوزن وفي القدوري في مسألة الطنبور والبربط أنه يضمن قيمته خشبا منحوتا وفي المنتقى يضمن قيمته خشبا أو ألواحا كذا في المحيط والذخيرة (الفتاوى الهندية – 5 / 131)
