Changing intention from Hajj Tamattu to Hajj Badl

Question:

Assalamu Alaikum Wa Rahmatullah

Someone has already done the umrah of hajj-e-tamattu

Now he wants to do hajj-e-badl on behalf of someone else, is this permissible? (These persons own fardh hajj is already done.)

In the name of Allah, the Most Gracious, the Most Merciful.

Assalamualaikum Wa Rahmatullahi Wa Barakaatuh

In the scenario given, if a person who entered into the state of Ihraam of Hajj Tamatu then makes the intention of Hajj Badl, both these Hajjs will now become wajib upon him. However, given that at one time a person can only do Hajj either for himself (as Hajj Tamatu in this scenario) or Hajj Badl for someone else, the second one that he made intention for (i.e. Hajj Badl) will become void. Making an ihraam void is a violation in itself hence, the person will have to do the following:


  • Slaughter an animal

  • Come back the following year and make up the Hajj whose Ihraam became void (i.e. Hajj Badl)

  • An Umrah.[1]

This year he will continue with his Hajj Tamatu.

[1](قَوْلُهُ وَمَنْ أَحْرَمَ بِحَجٍّ إلَخْ) شُرُوعٌ فِي الْقِسْمِ الثَّانِي وَالثَّالِثِ أَعْنِي إدْخَالَ الْحَجِّ عَلَى مِثْلِهِ وَالْعُمْرَةِ عَلَى مِثْلِهَا. وَاعْلَمْ أَنَّ الْإِحْرَامَ بِحَجَّتَيْنِ فَصَاعِدًا، إمَّا أَنْ يَكُونَ عَلَى التَّرَاخِي، أَوْ مَعًا، أَوْ عَلَى التَّعَاقُبِ؛ فَالْأَوَّلُ مَا ذَكَرَهُ فِي الْمَتْنِ وَلِذَا أَتَى بِثُمَّ. وَأَمَّا الْأَخِيرَانِ، فَفِي النَّهْرِ يَلْزَمُهُ الْحَجَّتَانِ عِنْدَ الْإِمَامِ. وَالثَّانِي: لَكِنْ يُرْتَفَضُ أَحَدُهُمَا إذَا تَوَجَّهَ سَائِرًا فِي ظَاهِرِ الرِّوَايَةِ. وَقَالَ الثَّانِي: عَقِبَ صَيْرُورَتِهِ مُحْرِمًا بِلَا مُهْلَةٍ، وَأَثَرُ الْخِلَافِ يَظْهَرُ فِيمَا إذَا جَنَى قَبْلَ الشُّرُوعِ. وَقَالَ مُحَمَّدٌ: يَلْزَمُهُ فِي الْمَعِيَّةِ أَحَدُهُمَا وَفِي التَّعَاقُبِ الْأَوَّلُ فَقَطْ، وَالْعُمْرَتَانِ كَالْحَجَّتَيْنِ. اهـ.
