Does touching a member of the opposite gender break the wudu?

Answered as per Hanafi Fiqh by Askimam.org

I would like to know something. I am a Shafi and my husband is a Hanafi. I was once told that if a Hanafi makes wudu and then hugs or touches his/her hubby/wife whether it is a touch of the hand or a kiss on the cheek, intentionally or intentionally, their wudu doesn’t break.

I know if a non-mahram touches you, your wudu breaks no matter what school you follow. I would like to know if this is correct. Could you give me the ruling on this for both Shafis and Hanafis, more specifically as it applies to husband and wife?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Sister in Islam,

According to the Hanafi School of Thought, touching whether intentionally or unintentionally will not break one’s wudu  irrespective if the person touched is your spouse or not your spouse.[1] &[2]
