Expatiation for tawaafs performed whilst menstruating

Answered as per Hanafi Fiqh by Askimam.org

Asalamoalaikum

I have send you this mail many times before as well but I understand that you all are very busy kindly get some time for my question too and help me as well.

In the answer I was asked the exact days of menstural cycle at the time of performing Nafli tawaf unfortunately ,I donot remmember it now as it happened afew years ago,but my menstural cycle used to be around 6or 7 days with bleeding  and on 7 day usually I used to take ritual bath i.e with purification. when bleeding completeley stops but yellowish secretion remains and continues till next menstural cycle that is bleeding again .Approx .after 20 days .I am never dry. At the time of tawat it would have been more than 10 days of cycle but ritual bath was done  on 6or 7 day only .How ever I had regular baths and performed separate wadhu for each tawaf mostly during that time. I did not do it intentionally. Please guide me how can I do expiatation for it now? Can I perform those  tawaf again in future if I get a chance.please help.

JazakAllah

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

According to your explanation, your menstrual cycle was 7 days. [1] You would then take a ritual bath. However, your discharge would continue till the next cycle. Accordingly, the discharge after the 7 days menses was istihaadhah. [2]  A woman in istihaadhah is like a ma’zoor person. Refer to #28905 for laws pertaining to ma’zoor.

You mention that you made a new wudhu for every tawaf. [3] Accordingly, Your tawafs were valid.

And Allah Ta’āla Knows Best

For the non-menopausal woman, any colored discharge during the possible days of menstruation or lochia is considered menstruation or lochia unless it exceeds the maximum. If the blood exceeds the maximum, then all the days over the habit are considered istihada (dysfunctional bleeding) and the missed prayers and fasts must be made up.

Rules concerning haidh

9. She has the habit of bleeding for three days. But in a particular month, three days passed and she still had not stopped bleeding. She should not have a bath nor should she offer any salaat. If on the completion of ten days and ten nights, or before that, she stopped bleeding; then the salaat for all these days will be excused. She will not have to make any qada and it will be said that now her habit has changed and all these days will therefore be of haidh. But if she bled on the eleventh day as well, it is now established that only three days were of haidh and all the rest were of istihaada. She has to have a bath on the eleventh day and make qada for the salaats of the seven days. She should not leave out her salaat now.
