If you ever talk to your family, then divorce will automatically place

A friend of mine and his wife started having problems. The girls family started to intefere with their lives so much that the husband had to do something about it. So he told his wife that if she ever talk to her family again then their divorce will be automatically done. So after months of no talking to her family she finally talks to her family.Does this mean that their divorce is final now?

In the Name of Allaah, the Most Gracious, the Most Merciful.

As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

There are two issues in dealing with the wife in reference. One is, Shari’ah has made maintaining family ties fardh. To break family ties is a major sin. The other issue is avoiding the family interfering in his marriage. The husband should have used alternative means to avoid interference of the family. It was irresponsible of him to put a condition that causes his wife to choose between him and her family.

Nevertheless, if the husband suspended the divorce of his wife to an action in the future, it will automatically take place once the action is found[1].

In the enquired situation, we advise the husband to consult his local Mufti and present to him the actual statements of his conditional divorce for his assessment and advice. The laws of suspended divorce (ta’leequt talaaq) are intricate. The wordings, and at times, the circumstances will have to be considered.

وعندما يعلِّقُ شخصٌ طلاقَ زوجته على حصول شيء من الأشياء، وهو مدلول فعل الشرط، فلا يخلو الحال من أحد أمور ثلاثة:

الأول: أن يكون مدلولُ فعل الشرط معدوماً وقت التعليق، ويجوز حصوله. الثاني: أن يكون مدلولُ فعل الشرط محقَّقاً: أي موجوداً وقت التعليق. الثالث: أن يكون معدوماً ويستحيل حصوله.

فإن كان الأول؛ كما إذا قال الرجل لزوجته: إن كلمت فلاناً أو خرجت بغير إذني فأنت طالق كان التعليق صحيحاً، وينتظر حصول الشيء المعلَّق عليه الطلاق، وهو تكليم فلان في المثال الأول، والخروج بغير إذنه في المثال الثاني، فإن وُجِدَ وقعَ الطلاق، وإن لم يوجد فلا يقع.
