Can my mother preform Hajj with my father’s brother and his wife?

Question:

Salam,
  My father is a disabled man who suffers from polio and cannot perform hajj. My mother wishes to perform hajj. She would not be able to because she does not have a male with her. My brother and I are not able to go with her because of college. My mother wanted to know if she can go with my fathers brother and his wife. Those individuals both happen to be my mothers cousins, so would it be permissible for her to go with them. Thank you for your time. Jazakullah Khair.

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh..

According to the Hanafi Madhab (School of Thought), it is not permissible for a woman to travel to Hajj without a Mahram.[1]

Your father’s brother is not your mother’s Mahram, therefore it would not be permissible to perform Hajj with him[2].

The importance and excessive reward of Hajj is understood from many Ahadeeth. Therefore, it is imperative you exert all efforts in trying to take your mother for Hajj.

“‏ مَنْ حَجَّ لِلَّهِ فَلَمْ يَرْفُثْ وَلَمْ يَفْسُقْ رَجَعَ كَيَوْمِ وَلَدَتْهُ أُمُّهُ ‏”‏‏.‏

The Prophet (ﷺ) said “Whoever performs Hajj and does not commit any obscenity and wrongdoing, he, or she, will come out as the day he, or she, was born – pure and sinless.”(Bukhari)

In another Hadith,

‏ “‏ الْعُمْرَةُ إِلَى الْعُمْرَةِ كَفَّارَةٌ لِمَا بَيْنَهُمَا، وَالْحَجُّ الْمَبْرُورُ لَيْسَ لَهُ جَزَاءٌ إِلاَّ الْجَنَّةُ ‏”‏‏.‏

Allah’s Messenger (ﷺ) said, “(The performance of) `Umra is an expiation for the sins committed (between it and the previous one). And the reward of Hajj Mabrur (the one accepted by Allah) is nothing except Paradise.”(Bukhari 1773)

Furthermore, you will gain immense blessings and Barakah both in this world and the Hereafter by helping your mother and taking her for Hajj.
