Can I give zakat to my brothers and sisters?

Answered as per Hanafi Fiqh by AnswersToFatawa

Assalamu alaikum warahmatullahi wabarakatahu,

I got married last year on 25th July’15 and my wife has around 304grams of Gold ornaments which was given by her parents (Includes 16 grams of gold of Mahr).

Am I eligible for Zakaat this year? If yes, please let me know the calculation. Can I give zakaat to my own sisters and brother, as they are not in a position to making savings and struggling to get the things settled.?

What is the deadline to give zakaat this year?

Please provide a better solution to make savings to give zakaat easily on next year.

Jazakallahu khairan.

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

  1. The minimum nisaab of gold is 87.475 grams[1]. Your wife’s jewellery exceeds that amount. Hence, zakat is compulsory on her. She has to pay 2.5% of the current value of the actual gold in zakat.
  2. We do not understand your query…Am I eligible for zakat this year? If you do not possess the nisaab of zakat, you do not have to pay zakat. Your wife is responsible to pay her own zakat.
  3. Zakat can only be given to the rightful recipients of zakat[2]. Allah Ta`ala says;

{ إِنَّمَا الصَّدَقَاتُ لِلْفُقَرَاءِ وَالْمَسَاكِينِ [التوبة: 60]

Translation:

Alms (zakat) are only for the poor (who have nothing or very little), the destitute (people whose total wealth is less than the value of nisaab)

Therefore, your brother or sister will only be eligible to receive zakat if they don’t have excess wealth equivalent to 87.475 grams of gold or 612,34 grams of silver[3] or their equivalent value in local currency besides his/her basic needs[4].

  1. There is no particular date/deadline for paying zakat. However, one should try to pay his zakat after the completion of his zakat year. For example, if a person became an owner of nisaab on 15 Shabaan 2015, the following year he will dispense his zakat from 15 Shabaan.
  2. Your question is very general. This is according to a person’s financial condition.
