Can a Moment of Anger End My Marriage?

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: My husband and I have been married for four years and we have arguments where sometimes the arguments escalate to levels where they shouldn’t. During these arguments I find myself provoking my husband to say talaq and divorce me again and again. In the past he has refused to say it. The most recent argument lead me to call the police in anger, as I dialled the number my husband said “I am giving you talaq, talaq, talaq”. He said this in extreme anger at the threat of me calling the Police on him. And then he apologised instantly. In the past, my husband has always thought talaq said in anger doesn’t count, he didnt know such a serious decision could be made in a state on emotional anger. And admits he is naive religiously so didn’t know saying this word could potentially lead to instant divorce. He says if he knew that it could mean that then he would have never ever said it. After being informed by a family member that this could be divorce. My husband has been to seek advice at the mosque he has been to since a child and they have advised him this has counted as 1 talaq. He believes I should follow the advice that he has sought from his mosque. I obviously do not want to end my marriage because of a moment of insanity and naivety, but my dad is a from a different school of thought who be lives this marriage is now over. Should I follow the advice that my Husband has sought or my father. Further the talaq was given in extreme anger due to my direct insults and threats and secondly my husband had no idea about the way in which talaq is given. Please can you advise.

Bismillaah

A: Three talaaqs have taken place.

And Allah Ta’ala (الله تعالى) knows best.
