One of the conditions of Hajj is the possession of necessary transportation either through ownership or hire. One should not borrow or obtain free of charge. etc) I’m not sure if what I intend to do violates these stipulations: My father works in a travel agency and can obtain free transportation for me and my wife to Saudi Arabia. If i use this to go on Hajj, does this violate the stipulation?
In the Name of Allah, the Beneficent, the Merciful, and all blessings and peace upon our master Muhammad, his Folk, Companions and those who follow their noble way,
The conditions and stipulations you mentioned mean that Hajj will only be fard (obligatory) after one has the means to obtain necessary transportation, either through ownership (milk) or hire (ijara). If one can obtain the means for free (ibaha) or through borrowing (i`ara), in these two cases it will not be fard (obligatory) to go on Hajj. (F: Because often things are given for free or lent with tangible or intangible strings attached.)
Yes, it would be permissible to go if one is given free transportation, but it is not necessary for one to accept. Thus, Hajj does not become fard in such a case, because the condition of obligation (wujub) is that one does not have to borrow or seek out the means (for free), if one is not already in the possession of the conditions such as sufficient money, means of transportation, and so forth.
