Surah Faatiha in the 3rd and 4th rakaat

Q: I want to ask whether I have understood a masalah correctly: In a book it was stated that according to some Hanafi ulama reading Fatiha in the 3th and 4th rakat is Sunnah, and according to some Hanafi ulama it is Wajib.

Then the book stated if Fatiha is read twice in the 3th and 4th rakat, there no sajdah sahw by ittifaaq.

Do I understand correctly that sajdah sahw is not due by ittifaaq because whether Fatiha is Sunnah or Wajib in the 3th and 4th rakat, it is not Wajib or Fard to go to ruku after recitation of Fatiha in the 3h and 4th rakat and it is permissible to read more, but since it is permissible and not Wajib or Fard, there is no delay for the ruku, hence by ittifaaq there is no sajdah sahw due if someone reads Fatiha twice in the 3rd and 4th rakaat, whether reading Fatiha in the 3th and 4th rakaat is Sunnah or Wajib.

But in the 1st and 2nd since it is Wajib to read a surah after Fatiha one would delay this Wajib if one was about to read Fatiha twice hence sajdah sahw is due because of delay. But if one reads in the 1st and 2nd rakat first Fatiha then a surah then Fatiha again then there is no sajdah sahw because going to the ruku after the surah is not Wajib or Fard and it is permissible to read another surah after surah. Hence no delay thus no sajdah sahw.

Did I understand this masalah correctly?

A: The correct view regarding reciting surah faatiha in the third or fourth rakaah of a fardh salaah is that it is sunnah. Furthermore one has the choice of reciting surah faatiha or reciting tasbeeh or remaining silent for the duration of three Subahaanallahs in the third and fourth rakaat. Hence if one recited surah faatihah twice in the third or fourth rakaat, sajdah sahw will not be waajib.

In the first and second rakaat if a person repeats surah faatiha before the surah, sajdah sahw will be waajib. The reason for sajdah sahw being waajib is that one has delayed the recitation of the surah which is a waajib. If one repeats surah faatihah after the surah, sajdah sahw will not be waajib.

And Allah Ta’ala knows best.

فلو قرأها في ركعة من الأوليين مرتين وجب سجود السهو لتأخير الواجب وهو السهو كما في الذخيرة وغيرها وكذا لو قرأ أكثرها ثم أعادها كما في الظهيرية أما لو قرأها قبل السورة مرة وبعدها مرة فلا يجب كما في الخانية واختاره في المحيط والظهيرية والخلاصة وصححه الزاهدي لعدم لزوم التأخير لأن الركوع ليس واجبا بإثر السورة فإنه لو جمع بين سور بعد الفاتحة لا يجب عليه شيء كذا في البحر هنا وفي سجود السهو قال في شرح المنية وقيد بالأوليين لأن الاقتصار على مرة في الأخريين ليس بواجب حتى لا يلزمه سجود السهو بتكرار الفاتحة فيهما سهوا ولو تعمده لا يكره ما لم يؤد إلى التطويل على الجماعة أو إطالة الركعة على ما قبلها ا هـ (رد المحتار 1/460)

( واكتفى ) المفترض ( فيما بعد الأوليين بالفاتحة ) فإنها سنة على الظاهر ولو زاد لا بأس به ( وهو مخير بين قراءة ) الفاتحة وصحح العيني وجوبها ( وتسبيح ثلاثا ) وسكوت قدرها وفي النهاية قدر تسبيحة فلا يكون مسيئا بالسكوت ( على المذهب ) لثبوت التخيير عن علي وابن مسعود وهو الصارف للمواظبة عن الوجوب (الدر المختار 1/511-512)
