Q: A fruit from the neighbour’s tree fell into my land and remained there until it grew into a tree. To whom does the tree belong?
A: The tree belongs to the neighbour.

قوله ( عقد على الزرع ) يصح أنه يراد بالزرع الصدر واسم المفعول لما في البزازية زرع أرض غيره بغير إذنه ثم قال لرب الأرض ادفع إلي بذري فأكون أكارا إن البذر صار مستهلكا في الأرض لا يجوز وإن قائما يجوز معناه أن الحنطة المبذورة قائمة في الأرض ويصير الزارع مملكا الحنطة المزروعة بمثلها وذا جائز لكن تفسد المزارعة لعدم الشرائط وإذا لم يتناه الزرع فدفعه إلى غيره مزارعة ليتعاهده صح لا إن تناهى اه سائحاني .(رد المحتار 6/274)
( ومتى فسدت فالخارج لرب البذر ) لأنه نماء ملكه ( و ) يكون ( للآخر أجر مثل عمله أو أرضه ولا يزاد على الشرط ) وبالغا ما بلغ عند محمد.(رد المحتار 6/279)
فلو غصب أرضا فزرعها كرين فأخرجت ثمانية ولحقه من المؤنة قدر كر ونقصها قدر كر فإنه يأخذ أربعة أكرار ويتصدق بالباقي وقال أبو يوسف لا يتصدق بشيء وبيانه في التبيين.(رد المحتار 6/187)
ثم يأخذ الغاصب رأس ماله وهو البذر وما غرم من النقصان وما أنفق على الزرع ويتصدق بالفضل عند أبي حنيفة وأبي يوسف رحمهما الله حتى إذا غصب أرضا فزرعها كرين فأخرجت ثمانية أكرار ولحقه من المؤنة قدر كر ونقصها قدر كر يأخذ منه أربعة أكرار ويتصدق بالباقي كذا في التبيين.(الفتاوى الهندية 5/121)

Q: So, if the tree belongs to the neighbour rightfully, in order to eat from that fruit, you need to ask the neighbour.
Now a different scenario regarding the same tree. What if a bird carried a fruit/seed from some arbitrary person’s yard. The seed then dropped in your yard and a tree grew. Who does that tree belong to?
To make it even more complicated, what if your neighbour has an apricot tree, but a bird also dropped a pit in the same area as where your neighbour’s tree hung over into your yard and a tree grew. We would then assume that it’s from the neighbour’s tree when in actual fact, the bird dropped the seed and it grew.
Please advise based on the above situations.
A: If you are certain that the seed belongs to the neighbour then the tree belongs to him.
