Zakaat on Mahr which was not received till the husbands death

Q: My father died without giving the meher money to my mother. After my father’s death my mother will get the meher money from his property. Then is it necessary to give zakat on that money calculated from the day of marriage or from the day my father died or the day my mother receives the money?

A: Zakaat will not have to be paid on the mehr amount for the past years. However, after receiving the mehr amount, zakaat will be compulsory upon it if it equals the nisaab of zakaat and remains with her for an entire lunar year. And Allah knows best.

( و ) اعلم أن الديون عند الإمام ثلاثة قوي ومتوسط وضعيف ف ( تجب ) زكاتها … عند قبض ( مائتين مع حولان الحول بعده ) أي بعد القبض ( من ) دين ضعيف وهو ( بدل غير مال ) كمهر ودية وبدل كتابة وخلع إلا إذا كان عنده يضم إلى الدين الضعيف

و قال في رد تامحتار : قوله ( إلا إذا كان عنده ما يضم إلى الدين الضعيف ) استثناء من اشتراط حولان الحول بعد القبض والأولى أن يقول ما يضم الدين الضعيف إليه كما أفاده ح والحاصل أنه إذا قبض منه شيئا وعنده نصاب يضم المقبوض إلى النصاب ويزكيه بحوله ولا يشترط له حول بعض القبض (رد المحتار 2/305-306)
