When Does Qurbani Become Waajib

Question:

I just want to find out regarding qurbaani in the following instance.

A person has about R4000.

They also have a 1/6 shareholding in a property company. The property is valued around R3 million. The company does not have cash reserves and has debts of R2 million.

1. Is qurbaani waajib on such a person?

2. Will the answer above be different if the person only has R1000 cash (instead of R4000).

 

Answer:

In both instances (whether he has R4000 cash with him or R1000), Qurbani will be Waajib upon the person.  

The fundamental rule is that if one owns the Nisaab amount (612,36 grams of silver) or wealth equivalent to the value of Nisaab, which is in excess of one’s basic needs (house, clothing, furniture, debts owing, etc.) on any of the three days of Qurbani, then Qurbani will be Waajib on him. 

In the enquired scenario, the 1/6 value of the person’s proportionate shareholding in the 3-million property amounts to R500000. If his proportionate 1/6 liability in the debt of 2-million (which amounts to R333333) is deducted, it still results in a surplus of R166667 in terms of the property-value. This will mean that yes, Qurbani will be Waajib upon such a person.

If this person does not have sufficient cash on hand to purchase a Qurbani animal, then he should dispose of some of his assets by selling them for cash or alternatively, he could borrow cash from someone, in order to fulfil the obligation of Qurbani.
