Aamil and Ruqyah

Question:

My mother was very concerned regarding my siblings and is convinced that someone is doing black magic and insisted that we call an Aamil. The Aamil doesn’t charge but asks us to do certain things like sacrifice an animal. the patient must touch the animal and then the animal is sacrificed and the meat is distributed. Some meat is also thrown into the river. Although, the procedure of sacrificing is normal and the name of Allah is invoked.

What is Ruqya and what is the Shariats ruling on the matter?
Is is permissible to see an Aamil? If so how do we check to see if the Aamil is legitimate?

Are such sacrifices permissible and do they have any basis in Deen?

Answer:

  1. Ruqyah is when a person reads a Quran Ayat or a Masnoon Dua and then blow it with a little bit of saliva on the afflicted person with the intention of Shifa (cure).

    Ruqya may also refer to Ta’weez (to write the Ayat or Dua and hang it around the affected person’s neck), especially for a person who cannot read Arabic.

    The action of Ruqya is established from Nabi G and the Sahabah M. Therefore, it will be permissible to do it if the following conditions are met:

    It must be in Arabic (e.g. Names of Allah, His qualities, His words or a Masnoon Dua) or if not, then its meaning must be known.
    The meaning of the words must be free from any Kufr or Shirk.
    The blower and the blown upon must believe that the true healer is Allah D and the words are only a means to attain it.

  2. It is permissible, if the Aamil is such that he does not prescribe any action which is against Shariat.
  3. One may ascertain the legitimacy of an Aamil with the following methods: the easiest and most reliable would be to ask a reliable Aalim/Mufti (scholar) in one’s area if he knows any such Aamil. One may also see if the action prescribed by the Aamil is in line with the Shariat or not. If in doubt then always refer back to the scholars of Deen.

  4. Such a sacrifice has no basis in Shariat and therefore will not be permissible. It is only permissible to sacrifice an animal where there is a Nass (explicit text in Quran or Hadith) for it, e.g. for Qurbani, or Aqeeqah, or the Damm of Hajj. Yes, it is a different matter that charity is given in the form of slaughtering an animal and distributing the meat to the poor. However, to throw it in a river is wastage and wastage is haram. The uncertain outcome of this “cure” doesn’t justify the wastage.M

والرقية، بالضم: العوذة التي يرقى بها صاحب الآفة كالحمى والصرع وغيرهما. (…) ورقية، بالضم، فهو رقاء، ككتان: نفث في عوذته فهو راق وذاك مرقى، (تاج العروس 38/175 دار الهداية)

(قوله باب الرقى( بضم الراء وبالقاف مقصور جمع رقية بسكون القاف يقال رقى بالفتح في الماضي يرقي بالكسر في المستقبل ورقيت فلانا بكسر القاف أرقيه واسترقى طلب الرقية والجمع بغير همز وهو بمعنى التعويذ بالذال المعجمة (فتح الباري 10/195 دار المعرفة)

ولو كان رقية في غلاف متجاف عنه لم يكره دخول الخلاء به والاحتراز عن مثله أفضل. (تبيين الحقائق 1/58 بولاق)

عن أم سلمة، رضي الله عنها: أن النبي صلى الله عليه وسلم رأى في بيتها جارية في وجهها سفعة، فقال: «استرقوا لها، فإن بها النظرة» (صحيح البخاري رقم: 5739)

حدثنا عبد الرحمن بن الأسود، عن أبيه، قال: سألت عائشة، عن الرقية من الحمة، فقالت: «رخص النبي صلى الله عليه وسلم الرقية من كل ذي حمة» (صحيح البخاري رقم: 5741)

عن عائشة، أن رسول الله صلى الله عليه وسلم كان يرقي يقول: «امسح الباس رب الناس، بيدك الشفاء، لا كاشف له إلا أنت» (صحيح البخاري رقم: 5744)

عن عائشة، رضي الله عنها: أن النبي صلى الله عليه وسلم كان يقول للمريض: «بسم الله، تربة أرضنا، بريقة بعضنا، يشفى سقيمنا، بإذن ربنا» (صحيح البخاري رقم: 5745)

حدثنا أبو النعمان، حدثنا أبو عوانة، عن أبي بشر، عن أبي المتوكل، عن أبي سعيد رضي الله عنه، قال: انطلق نفر من أصحاب النبي صلى الله عليه وسلم في سفرة سافروها، حتى نزلوا على حي من أحياء العرب، فاستضافوهم فأبوا أن يضيفوهم، فلدغ سيد ذلك الحي، فسعوا له بكل شيء لا ينفعه شيء، فقال بعضهم: لو أتيتم هؤلاء الرهط الذين نزلوا، لعله أن يكون عند بعضهم شيء، فأتوهم، فقالوا: يا أيها الرهط إن سيدنا لدغ، وسعينا له بكل شيء لا ينفعه، فهل عند أحد [ص:93] منكم من شيء؟ فقال بعضهم: نعم، والله إني لأرقي، ولكن والله لقد استضفناكم فلم تضيفونا، فما أنا براق لكم حتى تجعلوا لنا جعلا، فصالحوهم على قطيع من الغنم، فانطلق يتفل عليه، ويقرأ: الحمد لله رب العالمين فكأنما نشط من عقال، فانطلق يمشي وما به قلبة، قال: فأوفوهم جعلهم الذي صالحوهم عليه، فقال بعضهم: اقسموا، فقال الذي رقى: لا تفعلوا حتى نأتي النبي صلى الله عليه وسلم فنذكر له الذي كان، فننظر ما يأمرنا، فقدموا على رسول الله صلى الله عليه وسلم فذكروا له، فقال: «وما يدريك أنها رقية»، ثم قال: «قد أصبتم، اقسموا، واضربوا لي معكم سهما» فضحك رسول الله صلى الله عليه وسلم، (صحيح البخاري رقم: 2276)

وقد أجمع العلماء على جواز الرقى عند اجتماع ثلاثة شروط أن يكون بكلام الله تعالى أو بأسمائه وصفاته وباللسان العربي أو بما يعرف معناه من غيره وأن يعتقد أن الرقية لا تؤثر بذاتها بل بذات الله تعالى واختلفوا في كونها شرطا والراجح أنه لا بد من اعتبار الشروط المذكورة ففي صحيح مسلم من حديث عوف بن مالك قال كنا نرقي في الجاهلية فقلنا يا رسول الله كيف ترى في ذلك فقال اعرضوا علي رقاكم لا بأس بالرقى ما لم يكن فيه شرك. وأما النسك فيختص بالحرم بالاتفاق لأن الإراقة لم تعرف قربة إلا في زمان أو مكان (الهداية 1/160 دار احياء التراث العربي)

فالتقرب بإراقة الدم عرف بنص غير معقول المعنى فيفوت بمضي الوقت لأن مثله غير مشروع قربة للعبد في غير ذلك الوقت. (أصول السرخسي 1/51 دار المعرفة)

والتضحية، أي إراقة الدم في أيام النحر غير معقولة، لأنه إتلاف الحيوان (نور الأنوار ص 133)
