I work for one of the leading Business Process Outsourcing company in Banglore. Is my income Halal?

Answered as per Hanafi Fiqh by Askimam.org

I work for one of the leading Business Process Outsourcing company in Banglore.

The work I do is related to dealing with recovering losses on personal injury claims of a very big MNC in the United Kingdom.

The company has outsourced its insurance and claims business to our company.

This job does also involve riba and qimar as most of the accident claims have an element of fraud or lying by the people who make a claim.

We do a whole lot of checks and enquiries before paying out on a claim as it is huge racket of making a claim in the U.K.

My question is whether the money earned as a salary would be halal or not as I have read that it is not Halal to work for an insurance company.

But since our company is not an insurance company itself but has a contract from this insurance company, will the same rule apply?

Secondly, as precautionary measure, I had borrowed some money and used it in the month of ramazan as I have heard from Mufti Taqi Usmani.

Can I pay back using this money to friends who I had taken it from. Also can I pay the bank loan using this money?

Do I have to leave the job immediately or can I wait until I find another job.  If I leave the job, can I use the money I received from company PF account for my necessities?  Please give me a detailed answer and help me make the right decision in the light of Quran and Sunnah.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It is a sign of Imān that you have concern to purify your wealth.  May Allah grant you barakah in your wealth. Amīn.

The following is what we understand from the aforementioned query. The MNC in the U.K. has outsourced its insurance claims to the BPO you are working for in Bangalore.  However, the BPO is not involved in the insurance transaction itself, but merely checks and makes enquiries regarding the claims that are made.

However, another aspect of consideration is the source of your income. If the company you work for solely contracts itself out to Insurance companies and has no other source of income, then you should look for an alternative employment.  However if the company does not provide its services only for insurance companies, instead it provides its services for other companies as well or has other forms of income that are more than the income accumulated from the insurance companies, then your income is Halāl.
