Signed in the wrong place in the marriage contract. Is my Nikah valid?

Dear imam

I am happily married to my husband. My parents took my consent before nikah ceremony. During nikah ceremony i happily signed the nikahnama(marriage certificate) and accepted my husband from heart infront of witnesses. But i have little doubt. I signed the nikahnama above the place where bride was suppose to do. There is a section in nikahnama where its written ‘bride signature’ and bride is suppose to sign below it but by mistake i signed above that place. Is my nikkah valid?

In principle, if the eejaab (proposal) and qabool (acceptance) took place in the presence of two male witnesses, or one male and two female, then the nikaah will be valid, irrespective of whether the marriage contract was signed or not[1]. The validity of nikaah is not based on the signing of the marriage contract. Accordingly, your nikaah was valid.

فإن النكاح ينعقد بلفظين أحدهما عبارة عن الماضي والآخر عن المستقبل والشافعي ومحمد رحمهما الله تعالى سويا بينهما، والفرق لعلمائنا رحمهم الله تعالى أن البيع يقع ببغتة وفلتة فقوله بعني يكون استياما عادة فلا بد من الإيجاب والقبول بعده فأما النكاح يتقدمه خطبة ومراودة فقلما يقع بغتة

 

مختصر القدوري (ص: 145)

النكاح ينعقد بالإيجاب والقبول بلفظين يعبر بهما عن الماضي أو يعبر بأحدهما عن الماضي وبالآخر عن المستقبل مثل أن يقول: زوجني فيقول زوجتك. ولا يعقد نكاح المسلمين إلا بحضور شاهدين حرين بالغين عاقلين مسلمين أو رجل وامرأتين

وأما ركن النكاح فهو الإيجاب والقبول. وذلك بألفاظ مخصوصة، أو ما يقوم مقام اللفظ
