Taking off the hijaab if it becomes illegal in one’s country

Answered as per Hanafi Fiqh by Askimam.org

If it became illegal to wear the hijab in the country I live in should I take it off or keep it on?

Answer

In the Name of Allaah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Rasulullah (Sallallaahu ‘alaihi wasallam) said,

لا طاعة لمخلوق في معصية الله عز وجل[1]

Translation: “There is no obedience to the creation while disobeying Allaah the exalted and magnificent.” (Ahmad 1095)

Accordingly, it will not be permissible to take off the hijaab in the enquired situation. If a Muslim community is faced with such a situation, they should use the right of freedom of religion which is an entrenched clause in every democratic dispensation to defend their rights with dignity and honor.
