Kaffarah for sexual intercourse

Answered as per Hanafi Fiqh by Askimam.org

I have a question in regards to fasting in Ramadhan.

I am young and have recently married I wanted to ask?

What is the kaffarah for missing one fast if one indulges in sexual activity with your spouse?

Also if the kaffarah is 60 consecutive days? Is there anything else one can do in regards to the qaffarah. As 60days is a long time and it would be difficult to fast for so long.

Is it permissible to keep one qadha fast and pay for 60 days missed fast.

Secondlly, I have read the hadith bukhari savm 30, hibe 20, nafakat 13, keffarat 2-4; muslim: siyam 81; ebu davud: tahare 124, savm 37.

According to hadith I have not found out what one can do when 1 fast is broken by sexual activity.

Thirdly if one had no idea of what the kaffarah is or was or had forgotten, is there any exception for breaking the fast.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, if one had intercourse with one’s wife in Ramadhan in the state of fasting, then one will have to fast 61 days; one day Qadha and 60 consecutive days.[i] [ii]

Consider the following Hadith:

Translation: A man came to Rasoolullah ﷺ and said, “I am ruined.” Nabo ﷺ asked, “What do you mean?” He said, “I had a sexual intercourse with my wife during Ramadan (while fasting).” Nabi ﷺ asked him, “Can you manumit a slave?” He replied in the negative. He then asked him, “Can you fast for two successive months continuously” He replied in the negative. Nabi ﷺ then asked him, “Can you feed sixty poor persons?” He replied in the negative. In the meantime, an Ansari came with a basket full of dates. Nabi ﷺ said to the man, “Take it and give it in charity (as an expiation of your sin).” The person said “Should I give it to some people who are poorer than us O Allah’s Messengerﷺ? By Him Who has sent you with the Truth, there is no family between Medina’s two mountains poorer than us.” Nabi ﷺ told him to take it and provide his family with it.” (Sahih Al-Bukhari: 2600)

Mulla Ali Qari Rahmatullahi quotes Qadhi Ayadh and Ibne Hajar $ who both state that the above Hadith proves that Kaffarah must be in the above order; if it is not possible to free a slave, then one must fast for sixty days consecutively.[iii]

As for Nabi ﷺ telling the person to give the dates as Sadaqah, and then to his family, Mulla Ali Qari states that this was according to the financial situation of the person. [iv] From a principle point of view, such a person still had to fulfil Kaffarah when his financial situation improves.[v]

In conclusion, the above-mentioned Hadith proves that a person who breaks his fast through sexual intercourse must observe the Kaffarah as stipulated in the Hadith.
