Fajr after shurooq; holding husband’s hand; praying before azaan is called

I would like to ask a few questions,

1. After shuruq can you still pray fajir? I mean will it be on time or will it be qatha’?

2. If you hold your husband’s hand does it break your wudu’?

3. If it is now time for asr or any prayer, and we didn’t hear the call to prayer at the mosque, because we are in North America and they don’t broadcast the call to prayer but the program on our computer/phone or the prayer time table we got from the mosque says it’s now time for asr, can you still pray thuhr? Can you pray asr or do you have to make sure that they made the call to prayer at the mosque?

In the Name of Allaah, the Most Gracious, the Most Merciful.

As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

The answers to your queries are as follows:

1.      One should endeavor to perform salaah at its prescribed time. Delaying salaah till after its time has lapsed is a grave sin. One should make tawbah and istighfaar.

In the enquired situation, if one performs Fajr salaah after shurooq/ishraaq, it will be considered qadhaa[1]. He should make sincere tawbah.

2.      According to the Hanafi legal school, holding one’s spouse’s hand does not break wudhu[2]. However, according to the Shaafi’ee and Hanbali schools, wudhu will break.

3.      Salaah will be valid as long as the time has come in, irrespective of whether one hears the azaan or not. One may pray the respective salaah until the time of that salaah ends, irrespective of whether the azaan of the next salaah has been called or not. Once the time for the next salaah comes in, the previous salaah will become qadhaa if it had not been prayed.
