Are the following scenarios considered Gheebah?

Answered as per Hanafi Fiqh by Askimam.org

I understand your taking on videos/pictures, but please strictly confirm whether the following scenarios can be considered as an act of gheebat. This is on behalf of a friend.

1) There a video on YouTube that went viral of Junair Jamshed getting beat up by a bunch of thugs at Isalamabad airport. My friend shared it with his family friends just to merely share news, but there was no malicious intent in his heart to expose him as such. It was already all over the net.

2) The reason why he was attacked is because over a year ago he overly dramatised a particular Hadith involving a little comical moment between Aisha (RA), and the Prophet (SAW). What he said was right, but the way he said it against adaab. So, he shared the YouTube video of this talk to those who were now curious after having watched him get attacked because of it. Again no malicious intent, but merely to fill them in, and to justify how people have blown it out of proportion.

Has the brother committed gheebat in both scenarios.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

1 & 2.) This question of gheebah and its relation to media has been answered previously. Please see Ask Imam #34441 at:  HYPERLINK “http://askimam.org/public/question_detail/34441”http://askimam.org/public/question_detail/34441

Note:  Every Muslim should take the utmost care not to “share” or “forward” everything he come across. Rather, he should diligently evaluate whether the source material is proper, authentic and conveys ilm with due etiquette to our pious predecessors before he even considers sharing it with others. The respect of Rasulullah (salallahu alayhi wa sallam), the companions (may Allah be pleased with them), and all our pious predecessors (may Allah have mercy on them) should always be paramount.
