Did two or three talaqs occur ?

My brothers wife confessed to have feeling for the guy down the road.

He issued a talaaq raji with a condition saying if she has any communication then it takes effect. she violated the talaaq.

He issued a second talaaq raji without any condition after which he took her back by hugging her. when it was told to her that she must check the valadity of her nikaah she mentioned that on several occasaion while discussing there marriage my brother told her ,”i am done with you , it over ” . does there nikaah terminate completly .does she have to remarry someone before they get back together . if they live together are they in sin.

Please advise as we want to be carful not to break the law of Allah Ta’ala.

 

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

We understood from the information provided;

1) The husband issued a divorce on the condition that if his wife speaks to an individual, she’ll be divorced. She spoke to the individual and therefore the talaq took place.[i]  

2) He issued a revocable divorce and thereafter hugged her whereby the divorce was retracted.[ii]

3) The wife quotes her husband saying “I am done with you, it (is) over”.

If her husband intended divorce while saying those words, divorce will take place. As such, this will be the third divorce which terminates the nikah completely. They cannot stay together as husband and wife.

If he did not intend divorce, she will not be divorced.[iii]

اگر صریح طلاق معلق کی ہے تو بعد تحقق شرط رجعی طلاق واقع ہوگی اور اگر بائنہ کو معلق کیا ہے تو بائنہ واقع ہوگی غرض جیسی طلاق معلق کی ہے بوقت تحقق ویسی ہی واقع ہوگی
