Can i give interest money to a maulana in debt, Zakat on a business asset

Answered as per Hanafi Fiqh by Askimam.org

As salaamu alai kum!

I need to know whether I can dispatch my interest money to a known person (Maulana) who is in big debt since long. It is not that I am not capable of giving my own money to pay his debt but I was thinking whether I can mix the amount as the amount is quite big.

If yes, do I have to tell him that there is a portion of interest money in this? Do I have to include majority good money and some portion interest money or vice versa.

Also, regarding zakaat, what is the ruling for zakaat on apartment which are bought for giving rent till I get good value to sell it; I myself live in rented flat out of country; similarly ruling of zakaat on agricultural land as well as normal land which are bought as purpose of long term investment.

Many thanks in advance for responding. Jazakallah.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

1)    Interest money should be disposed to a poor and needy person. If the person in reference is in debt and he is poor and needy, he qualifies as a recipient of interest money. If you assist him with your own money too, that will be an act of charity and great reward.[i]

2)    It is not a condition for the recipient to know that the money he is receiving is interest.[ii]

3)    If you bought the apartment with the intention to rent it out and when the price goes higher you will sell that apartment, then such a property will not be considered a business asset. However, the income from the rent will be added to your cash in hand and will be liable for Zakat according to your personal financial situation. [iii]

4)    In principle, if a land is bought with the intention to sell, then such a land will be considered as a business asset and will be liable for Zakat.[iv]
