Khula’

Assalamualaikum,

I wanted to know if there is any compulsion to have witness when a woman is giving qula.And if she has given qula to someone with one witness from her side and now she wants to get back to her husband,I wanted to know whether the qula is done or she can go back to her husband? Kindly explain me with ref of Quran and Hadith.

  1. There is no need for the witnesses to be present in Khula’, however, it is better to have some witness so it could be helpful in need and there is a proof.
  2. The Khula’ does not take effect with a woman giving/taking Khula’ unless the husband accepts it. If the situation is as described then the Khula’ did not take effect. The woman is still in the Nikah of her husband. On the other hand if the husband has accepted the Khula’ then it will be Talaq-e-Bai’n. If the number of Talaq is less than 3 then a new Nikah is necessary to have the married relations again.

عَنِ ابْنِ عَبَّاسٍ، أَنَّ امْرَأَةَ ثَابِتِ بْنِ قَيْسٍ أَتَتِ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَالَتْ: يَا رَسُولَ اللَّهِ، ثَابِتُ بْنُ قَيْسٍ، مَا أَعْتِبُ عَلَيْهِ فِي خُلُقٍ وَلاَ دِينٍ، وَلَكِنِّي أَكْرَهُ الكُفْرَ فِي الإِسْلاَمِ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «أَتَرُدِّينَ عَلَيْهِ حَدِيقَتَهُ؟» قَالَتْ: نَعَمْ، قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «اقْبَلِ الحَدِيقَةَ وَطَلِّقْهَا تَطْلِيقَةً»(صحیح بخاری:کتاب الطلاق، 5273)

إذا کان بعوض الإیجاب والقبول؛ لأنہ عقد علی الطلاق بعوض، فلا تقع الفرقۃ، ولایستحق العوض بدون القبول۔ (شامي / باب الخلع ۵؍۸۸ زکریا، ۳؍۴۴۱ کراچی)

لو ادعت الخلع لا یقع بدعواہا شيء؛ لأنہا لا تملک الإیقاع۔ (شامي ۵؍۱۰۲ زکریا)
