Borrowed on interest

Answered as per Hanafi Fiqh by Qibla.com

Answered by Shaykh Faraz Rabbani

I apologise beforehand about the the long question. about 6 months ago my brother in law was in a difficult financial situation where he was about to have his house taken from him. He has a son and another baby on the way. He asked me to help him by getting a loan from the bank to pay off some debt and promised to return it within 2 months and in between that time he would keep making the monthly payments for this loan. it has been six months now and I have not received the total amount back and he has also missed a few payments. Firstly I can’t afford to make payments for him and thirdly I’m worried about the Riba on this. I’ve also been made aware that according to Hanfi fiqh I have to wait until he is in a position to pay me Please advise whether this is true or if I can push him to return the loan so i can pay the bank and stop the interest.

Answer:
In the Name of Allah, Most Gracious, Most Merciful

Walaikum assalam wa rahmatullah,

This is not a good situation, Subhan Allah. You should seek repayment–in full, or in agreed-upon installments–from your brother-in-law, and take the means to repay the bank as quickly as reasonably possible.

And Allah alone gives success.
