Bismillahir Rahmaanir Raheem Al Jawaab Billahit-Tawfeeq Respected questioner. A recorded Azaan does not suffice as a Shar’ee Azaan and the Sunnat of giving Azaan in the newborn baby’s ear will not be fulfilled.[1] If no Male family member who is a mahram of the mother is available nor a Muslim Male is available; in which case he{the Male} will perform the Azaan and Iqaamah not in the presence of the mother maintaining modesty, privacy and morality, it would be permissible for a woman to perform Azaan in the right ear of the child and Iqamah in the left ear of the child, the mother will only be allowed to perform the Azaan and Iqamah if she is free from post-natal bleeding(Nifaas), if no Muslim Male is available[2] And Allah knows best It is stated in Fatawa Raheemiyyah: “ٹيپ ريكارڈ سے أذان دى جائےگى تو وه اذان معتبر نہيں پهر سے اذان دينا ضرورى ہے….” “If Azaan is given played from a tape recorder, this Azaan is not valid. Azan will have to be repeated.” It also states in Khayr ul Fatawa: “Azaan played from a tape will not be equivalent to the Shari’i Azaan, thus the Sunnat of Azaan will not be gained” [2] (قَوْلُهُ: لِلرِّجَالِ) أَمَّا النِّسَاءُ فَيُكْرَهُ لَهُنَّ الْأَذَانُ وَكَذَا الْإِقَامَةُ، لِمَا رُوِيَ عَنْ أَنَسٍ وَابْنِ عُمَرَ مِنْ كَرَاهَتِهِمَا لَهُنَّ؛ وَلِأَنَّ مَبْنَى حَالِهِنَّ عَلَى السَّتْرِ، وَرَفْعُ صَوْتِهِنَّ حَرَامٌ إمْدَادٌ، “Regarding women it is disliked for them to give the Azaan, similarly the Iqaamah{for Salaah} as narrated from Hadhrat Anas (Radhi Allahu Anhu) and Hadhrat Ibn Umar (Radhi Allahu Anhu) that they are both disliked for them, as their state is based on concealment (maintaining Satr).” In Ahsan Ul Fatawa it describes the Azaan performed upon a newborn saying: “it is the same manner as Azaan of Salah, however in style it differs as the voice is not raised” As there is no raising of the voice and satr is still maintained, thus it would be permissible for a woman to perform Azaan and Iqamaah upon the new born baby, if no Male is available. It also states in Radd ul Muhtaar; It states in Khayr ul Fatawa “اصل يہ ہے كہ نومولود كے كان ميں كوئي مرد صالح اذان دے تاكہ صورتاً بھي كراہيت نہ ہو- مراقي ميں ہے- ” The rule is that Azaan in the ear of a newborn baby should be given by a pious man, so that it doesn’t seem Makruh, it is stated in Maraqi Al Falah (Sharh Nur ul idaah); The implication from this reasoning is that a woman can give Azaan in the ear of a newborn baby as the voice isn’t raised in this nor is it against Satr.” It states in Fatawa Mahmoodiyah; ” In the maternity ward, at the time of giving birth if there is no male available, then the woman can perform this Azaan & Iqaamah……. It is Makruh e tahrimi to give Azaan and Iqamah in the state of impurity as stated in Radd ul Muhtaar: And Allah knows best ————————————– |
