Who is a Musaafir, etc?

Question:

Dearest Mufti, please enlighten me on the following few aspects:

1.  Can I perform Qadhaa Salaat whilst I am a Musaafir?

2.  If I had ink, etc on my hands/face and performed Wudhu thereafter Salaat, will my Salaah be accepted?

3.  Can I perform Salaah with gloves and a hat which covers my forehead?

4.  If I began reciting something inappropriate in Salaah (e.g. Surah Fatihah in Tashahhud position, etc), Sajdah Sahw becomes necessary or not?

5.  Am I considered to be a Musaafir if I travelled EXACTLY 78 kilometres?  Note:  Mileage shown on speedometer of car, nothing to do with Shar’i miles, etc.

6.  If I travel 50 kilometres then stop for one day, then proceed with my Safar for a further 50 kilometres, will I be Musaafir or not?  Do I perform Qasar Salaah from day one of travel?

7.  How many days of travel are required for one to be regarded as Musaafir?

8.  Is it permissible to listen to the voice of a female on the radio, etc?


Answer:

1.        If the Musaafir is in haste, he should delay his Qadhaa Salaah until such a time that there is some form of serenity in his journey.  If this Salaah that he wishes to make Qadhaa of was omitted while he was not a Musaafir, then although he is presently on Safar, he will perform the full Salaah.  If he missed this Salaah whilst he was a Musaafir then he will perform Qasar Salaah. (Raddul Muhtaar, Vol. 1, Page 588)

2.        If the ink is permeable, then the Salaah will be accepted.

3.        a.)  Salaah performed while wearing gloves is correct.

b.)  Salaah performed while wearing a hat that covers the forehead without a valid excuse is Makrooh.  If there is a valid reason, once the hardness of the ground can be felt, then Salaah will be correct.  (Ad-Durrul Mukhtaar, Vol. 1, Page 370)

4.        Reciting something inappropriate in Salaah will render Sajdah Sahw compulsory on the person.  (Fataawaa Rahimiyyah, Vol. 1, Page 242)

5.        If you travel for exactly 78 km once you have made the intention of Safar, you will be Musaafir.  (Raddul Muhtaar, Vol. 1, Page 568)

6.        In order to become a Shar’i Musaafir, the intention to cover more than 78 km is necessary at the beginning of Safar.  Without this intention, a person will not be considered to be Musaafir if he travelled 50 km then stopped, thereafter continued for 50 km then stopped.  On his return journey if 100 km will be covered then only will he be considered to be Musaafir.

7.        Three days of journey was equated to 78 km.

8.        It will be permissible to listen to the voice of a female out of necessity if there is no enjoyment, sensual delight or pleasure attached to it.  (Raddul Muhtaar, Vol. 1, Page 299)
