Aslam u Allay Kum Dear Mufti Sahib My question is my wife go to her parents home and after that she and her parents told me that if you want your wife and child than you come and live at her city but its immposible to me after that they told me if you cannot come here than we send police after that i afraid and than my advocate guide me if you send talak than you safe from police and legal matters. But my intention is not to send talak because in my thinking i cannot break my relationship after that I send a written triple talak but I cannot say talak to her and also i cannot know about talak. After that within iddat period she told me she cannot accept that talak and i also told her i cannot give you talak its only for my defence to safe the litigation matters. Mufti sahib please, please, please save my home from break-up and tell me can this talak is right or wrong or can she come to my home again without hala. Answer:
(Fatwa: 1913/D=397/K=1431)
The word of ‘talaq’ is sarih (clear). Talaq takes place by pronouncing or writing without intention as well. So, when you have sent three talaqs by writing with your hands or by getting it written on your behalf then your wife was divorced with three mughallazah talaqs (irrevocable divorces) and the relation of both of you came to an end. Now she cannot live with you without a valid halalah.
