If I am working away from home, is home watn asli?

I was born in a place which is 100 kms away from Hyderabad, then my family migrated to Hyderabad after my birth. The time I stayed at my birth location is not known to me.My family purchased a house in Hyderabad and we all shifted to Hyderababd. I have been there for about 24 yrs (approx). Now I am working in Trivandrum, Kerala which is about 1000 kms from Hyderabad.If I go to Hyderabad for less than 15 days, do I need to perform Qasar in Hyderabad ?

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa rahmatullāhi wa barakātuh. 

In principle, one will not perform Qasr at his Watn Aslī, regardless of whether he is staying there for less than fifteen days or more.

A place is determined as Watn Aslī in either of the two following ways:

  1. One keeps his wife and/or children in that area
  2. One makes firm resolve to take that place as his permanent residence[1]

If you have a wife or children in Hyderabad, you will not perform Qasr there. Similarly, if you have resolved to take Hyderabad as your permanent place of residence, while your place of work is only a temporary residence, then that will be regarded as your Watn Aslī and you will not perform Qasr.

If on the other hand, you neither have a wife or children residing in Hyderabad, nor have you accepted it as your permanent place of settlement, it will not be regarded as your Watn Aslī in spite of your parents living there. Hence, you will perform Qasr when in Hyderabad for less than 15 days from your workplace.

The same principle applies to your birthplace.[2]

[1] ومن كان له وطن فانتقل عنه بكل أهله واستوطن غيره ثم سافر فدخل وطنه الأول الذي كان انتقل عنه لم يتم الصلاة من غير نية إقامة، لأنه لم يبق وطنا له. والأصل في ذلك: أن الوطن الأصلي يبطل بمثله دون السفر عنه ووطن الإقامة يبطل بمثله وبالسفر عنه. قيدنا الانتقال بكل الأهل لأنه إذا بقي له فيه أهل لم يبطل ويصير ذا وطنين (اللباب في شرح الكتاب، دار البشائر الإسلامية، ج.٢ ص.٢٤٤-٥)

الوطن الأصلي يسمى بالأهلي ووطن الفطرة والقرار كما فى القهستاني، وهو موطن…تأهله أي اتخاذه أهلا أي تزوج بها…وفى الكافي وهو ما يكون بالتوطن بالأهل والولد حموي…وفي شرح المنية: لو كان له أبوان ببلد غير مولده وهو بالغ ولم يتأهل به فليس ذلك وطنا له إلا إذا عزم على القرار فيه وترك الوطن الذي كان له قبله انتهى (طوالع الأنوار، مخطوط، ج.٢ ص. ٤٦٠)

[2] (الوطن الأصلي) يبطل بمثله سواء كان بينهما مدة السفر أو لا، فمن ولد بمكة وكانت له وطنا أصليا ثم ارتحل عنها إلى المدينة واستوطنها ونقل أهله إليها فخرج مكة من أن تكون له وطنا أصليا حتى لو دخلها كان مسافرا لانتفاء كونها وطنا له، ألا ترى النبي صلى الله عليه وسلم بعد الهحرة عد نفسه بمكة من المسافرين في حجة الوداع؟ (المصدر السابق)
