Working in a bank as a tax advisor/consultant

Assalamualaikumwarrahmatullahiwabarakaatu, I wanted to query if they are any exceptions in regards to working for a bank. We’re currently not financially stable however my husband has just got a brilliant job offer from a bank- on a 12 month contract. The pay is significantly better than what he’s on at the moment which means we would be able to pay off some of his debts and maybe also save some money if he has to take up this new role with the bank. He currently commutes daily and by taking up this job, not only would we be saving some money, he would also be working near home saving him a daily 2 hour commute meaning he would be home earlier than usual to spend time with our children before dinner. I understand that working for a bank means being paid money that has been earned through interest, however, I was wondering what the exceptions are, if any. The position that he has been offered is a tax advisor/consultant. Jazakallah

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

 

Respected sister.

It is permissible to work in a bank as a tax advisor/consultant. The income will be halaal. This is on condition that the job profile does not entail preparation of any documents that will be used in the actual insurance or interest transactions. If the job entails one being directly involved in insurance or interest-bearing transactions or documentation, then such a job is impermissible1.

1)      ولو أن رجلاً أهدى إليه إنسان يكتسب من ربا أو رجل ظالم يأخذ أموال الناس أو اضافة فإن كان غالب ماله من حرام فلا ينبغي له أن يقبل ولا يأكل من طعامه ما لم يخبره أن ذلك المال أصله حلال ورثه أو استقرضه أو نحو ذلك. فإن كان غالب ماله حلال فلا بأس بأن يقبل هديته ويأكل منه ما لم يتبين عنده أنه من حرام. (عيون المسائل للسمرقندي الحنفي (ص: 478)

 

وحاصل المذهب فيه أنه إن كان أكثر ماله من الرشوة والحرام لم يحل قبول الجائزة منه ما لم يعلم أن ذلك له من وجه حلال، وإن كان صاحب تجارة وزرع وأكثر ماله من ذلك، فلا بأس بقبول الجائزة ما لم يعلم أن ذلك له من وجه حرام، وفي قبول رسول الله عليه السلام الهدية من بعض المشركين دليل على ما قلنا. (المحيط البرهاني في الفقه النعماني (5/ 367)

 

آكِلُ الرَّبَّا وَكَاسِبُ الْحَرَامِ أَهْدَى إلَيْهِ أَوْ أَضَافَهُ وَغَالِبُ مَالِهِ حَرَامٌ لَا يَقْبَلُ، وَلَا يَأْكُلُ مَا لَمْ يُخْبِرْهُ أَنَّ ذَلِكَ الْمَالَ أَصْلُهُ حَلَالٌ وَرِثَهُ أَوْ اسْتَقْرَضَهُ، وَإِنْ كَانَ غَالِبُ مَالِهِ حَلَالًا لَا بَأْسَ بِقَبُولِ هَدِيَّتِهِ وَالْأَكْلِ مِنْهَا، كَذَا فِي الْمُلْتَقَطِ.
